They never decide what's right -- they always decide what's popular, elected or not, because judges are always elected by somebody (the ignorant masses or the ignorant future boss to be). Popular, of course, means who's the most powerful party -- the plaintiff or the defendant (excuse me if I am using the terms wrong here). Elections do not change human nature.

No. They get away because of blatant discrimination on the part of judges and juries. If tomorrow everybody ceased discriminating, more and bigger prisons for women would be built ASAP, since there is great coin to be made in the prison industry. The lack of prisons is an effect of the discrimination, not its cause as you falsely try to portray.
