I would lean towards wherever they go to school now, as long as someone will remain in that school district, they would be the custodial parent. And as most have said, the babysitter argument is pretty much nothing. Babysitters are able to care for the basic needs of children. You should calculate the overnight difference. I would include at least one bigger non-summer school break per year. Like Christmas break even years, spring break off years. 200 miles isn't a crazy distance for a long week…

A kid can't commute 200 miles to school on a regular basis. There could be consideration of summer break being with the parent not living in the school district.

Most men do not get that nowadays. What data are you looking at?

Parents are not entitled to 50/50 custody everywhere.

I got divorced last year. I was the dad doing the majority of the labor. What I learned during my divorce was how low a bar there is for adequate parenting in the eyes of family court. Unless there is serious abuse or neglect that you can directly link to measurable harm, they are probably considered an adequate parent. So let's just say you're an A- dad and she's a C+ mom. Guess what, you both passed! So then what else does the court care about? "Best for the children." I'm sure it varies somew…

Oh, well glad she was at least agreeable. I'm not in that position. Though I still get the batshit.

Did she agree to this setup or was it something that went to court and it was determined that the kids would be with you?

I'm not anti woman or anti mother. I just wish both sides were assumed to be equal parents until information proves otherwise. And if it didn't prove otherwise, 50/50.

I feel the same about her finally taking an active interest in parenting as a good thing. It just doesn't make sense to show up on the last day of a group project and demanding to be the only person to get credit.

I would sign up for that for sure. My problem is my ex was checked out for years leading up to the divorce, which is when she decided it was time to start being a present parent. Now she's trying to act like that's how it's always been.

I want to avoid a trial. But she doesn't demonstrate personal accountability or financial responsibility. All she's done is blame me for dragging this out while racking up a bunch of credit card debt on frivolous spending. She backed out of an agreement at the last second and decided she needed 80/20 so she could afford the house she wants. She wants the title of good mother, she's just not really been there to consistently do the work. I was just a bit ago reading through months of texts of her…

Was there a justification for the GAL demanding you accept less than 50/50? Also those statistics on that site managed to give me less hope. I already wasn't feeling great.

My lawyer says he has worked with her lawyer before and fully believes she's been told to stop doing the things she is doing because if it goes to trial a judge will not like it. But some people can't back off their position when they think they're right. Is she rational at all? Woof, hard question to answer. She can be reasonable until she is angry. That anger takes over and she's like a snarling dog defending a bone from hallucinations of people trying to take that bone away.

I really hope this happens in my case. I know everyone feels like their situation is special because they're in it, but I worry that I'm dealing with the less than 5% kind of person. But this is still nice to hear.

I'm going through the process now so I have no words of hope to share. I have a lawyer. At times I'm glad I do, at times it feels like an expensive 3rd party I'm paying to tell me "Yes I know she is being unreasonable. We can't make her be reasonable. Her lawyer can tell her to be reasonable and she doesn't have to listen." So far I have not been rewarded for being reasonable because none of it matters unless it goes to trial. It's playing a game of chicken with a person who is willing to lose t…
