For child support, income will be imputed to her based on what she should be earning (considering her education, experience, and earnings history). Unfortunately, the house is all hers. It was inherited so it is separate property. If you’ve paid the mortgage (if any) or helped to improve it any way that may be a factor to give you some credit, but otherwise you should consider the house as her own separate property. Alimony depends on the length of your marriage and the financial history of the …

Yeah I was gonna say the divorce rate may be down but that’s because the marriage rate is down. And yeah, divorce is not 50% of all marriages but more like 40% and declining as the rate of marriage declines. This will plateau and I imagine that in the future about 1/3 of marriages will end in divorce. And for each subsequent marriage the odds of divorce increase. This is a global trend. Some governments are paying their citizens to get married and start a family (I don’t think the government cov…

You should do whatever you did in prior years while married. Your attorney should be on this issue, and if they aren’t then you ought to email them abt it.

It’s not with the judge but yes the judge orders you to do it. If it’s just a settlement conference it’s usually both parties and their attorneys in a conference room at the court house. Possibly an in-court mediator is involved (these are people trained to mediate family law issues, they aren’t lawyers). You will then be ordered to participate in ESP or M-ESP, Matrimonial Early Settlement Panel. This is where cases make moves. You are assigned a panel of 2-3 practicing family law attorneys. You…

All joint credit cards should be effectively frozen upon the filing of the complaint for divorce. (The credit card company doesn’t freeze the account but a court order is entered that restrains the parties from using or dissipating marital assets.) If the court permitted the spouse to use a marital credit card for $15k legal fees but assigned the debt solely to the other party it is for a reason: other party is primary wage earner, the cost of legal fees will be offset in the final allocation of…

There are absolutely pro bono divorce attorneys available. As a family law attorney I am assigned 1-2 pro bono divorces per year by the local bar association/legal aid. Clients have to meet financial requirements to be eligible, but there is both pro bono (no cost to client) and reduced fee pro bono (client makes too much to qualify for pro bono representation but doesn’t make enough to afford private counsel). Contact local (county) bar association, state bar association, legal services/legal a…

Fire your attorney. Your attorney will prepare a substitution of attorney document. You will sign it and then the attorney will sign and file it with the court. It will be filed electronically and is effective upon the court’s receipt and stamped “filed” by the clerk. Usually instantaneous but can take a day. This assumes you don’t have a trial date scheduled within 90 days. If you do your attorney will have to file a motion. Edit: email your attorney to “discharge” them. Tell them you will be g…

Idk if you mean “soon” when you say “at some point in short distance” or if you mean an actual short distance away from you. If the latter then there is no issue. If the former, it still doesn’t present an issue unless the distance is significant or out-of-state. Regardless, the law requires her to get permission from the court to relocate out-of-state and also in-state if her move will have a substantial effect on the status quo and/or if moving would not be in the best interest of the child. Y…

Attorneys perform “conflict checks” prior to taking on new clients. You will not be told what the conflict is, but you will be told if there is one. If they represent your wife they will not even meet with you due to the conflict.

Are you currently representing yourself? I strongly advise that you get an attorney. You have 7 weeks before your next hearing. That’s plenty of time to find and retain an attorney. (Hire lawyer in the next week or so so they have time to prepare and take any necessary actions prior to the hearing.) I would want to know what can be done to terminate the supervision. Depending on the facts, a lawyer may want to file a motion and intercede to get the judge to terminate the supervision prior to 7 w…

I wish you included your age but I’m guessing you’re younger (20s-30s). The fact that you are here in this subreddit asking the question is all the answer you need. Get divorced. You’re married to someone who is not your partner. She sounds like she will leave you if a better opportunity arises. You have no children and you have limited risk regarding alimony (2 year marriage). I would file for divorce as soon as possible, bc the longer you wait the more entrenched you get in the marriage. Who k…

I mean you were only married for 2.5 years. Annualizing that $30k wage difference gets to a total gap of $75k over the marriage. I’d be shocked if alimony were ordered, but if it was I’d think a year is reasonable but at like $1,000/month. Either way, best thing is to just move on. Otherwise alimony payments keep you tied to a person you despise.

If you’re unwilling to compromise on your positions then it’s a waste of time. But realize that you will not get everything you want if you go to trial or make the judge decide any issue. Collaborative divorce can be good for high earners. A forensic accountant will be involved to ensure your financials are split correctly. You can’t have the mindset of getting one over on the ex if you want collaborative divorce to work. Realize that you’re getting divorced one way or another. Collaborative div…

It’s time to get a new attorney. Send an email to your current attorney right now. Tell her to close your file and that she may not bill any further to it. Tell her your new attorney will be in touch with a Substitution of Attorney, and that your file will need to be transferred so request that she prepare your file (it may be ready to go, it may be 100% electronic, or she may require it to be copied before transferring it to the new attorney. Don’t kid yourself about what a family court can do. For example, your spouse obtains a domestic violence restraining order against you. You’re out of the house and prohibited from entering, but since you paid the mortgage and utilities and all other household expenses you continue to be responsible for maintaining those expenses. On top of those “family” expenses you are now responsible for an apartment you had to rent for yourself. You can only visit with your kids one day a week for a few hou…

I think your lawyer means to deescalate by removing yourself from the home briefly. It gives you some space and time to try to relax, and it gives her the same. I’m talking like a half hour, not days. There’s no benefit to filing first. Once your answer is filed if you really feel it necessary tell your attorney to file a motion to address the disparaging comments and the interference with your time with your kids. A letter should be sent to her attorney first to try and avoid the need for a mot…

What did you see in this woman when you married her? And why does she have so much animosity towards your mother? Do you own property together? Do you want to keep the house or sell it? Advice will be a little different depending on various factors, but generally just do it!! End it. Be explicit. You’re done. She’s made your life suck, so ruin her day by serving her with divorce papers. And the next time she’s physical with you get a restraining order. That’s what they’re there for.

Your attorney can communicate all of these deficiencies to her attorney. Do NOT get divorced without ensuring these issues are resolved. If you still have concerns on 9/26 you MUST tell the judge on the record (orally in court). If you allow the divorce to proceed on 9/26 but there are outstanding issues you will have a much harder time resolving them, if at all. With the car, make an explicit provision in your agreement (or execute another agreement if you’ve already executed the MSA). State th…

You’re talking about economic mediation. Custody/parenting time mediation is in-courthouse with judiciary staff trained to mediate custody issues. There’s no time restrictions and it’s free for the litigants.

Did your custody evaluator meet with stbxw? What about collateral witnesses? Your stbxw is entitled to rebut your expert with her own custody evaluator. If you don’t reach an agreement then the issue of custody will be scheduled for a plenary hearing. If the complaint for divorce includes a request to establish custody then you can get a plenary hearing scheduled during a case management conference. Otherwise, a motion to establish custody is needed and the court will hear the motion, and then c…

You are required to resolve issues of custody and parenting time before almost anything else happens in your divorce. The Court should order you to custody/parenting time mediation, which is a court program with mediators right in the courthouse. Only if mediation fails will a judge decide custody issues. And there is a lot of pressure on the litigants and their attorneys to bring back a signed consent order resolving issues of custody/parenting time. The judge may send you back to mediation and…

You have to determine what you believe your income is and prove it to the court (or be prepared to prove it). You’re self-employed and you had a weird year last year. So that $11k is an anomaly, and your spouse would surely argue against its use in averaging income over 3 years. The court would likely impute income to you in the amount of what you could have earned. The court could also take the average of the other 2 years and impute that number to you for year 3. If one of these calculations i…

It sounds like you’re amicable. Have you had a conversation with her about this? Now would be the time. You’re going to have to keep contributing to the martial residence for a while. You’ve got 4 kids, it’s not so simple to just up and move. She needs to find a full time job. And depending on her education level and skills her potential income would be imputed to her. The financial burden of the house has to slowly shift her way. If you can avoid an alimony obligation by settling amicably, by y…

Not if he wants to retain the marital residence. Once he leaves he’ll never get back in. If he does decide to leave he better take all of his own personal property. If it’s marital and he takes it he will likely have to compensate his souse for her share of the value of the item. Anything he leaves in the house can “disappear” or never existed or he took it when he left idk what he’s talking abt.

Violating the TRO, which prohibits you from contacting her in any way, is a crime and you will be prosecuted for it, whether she wants that or not. It is also an aggravating factor which may be considered at the FRO hearing. If you want to communicate with her you can only do so through your lawyer. If you think you’re dealing with a clusterfuck now, go ahead and contact her and see how things really go to hell after that. You can’t pay for the result. It’s that simple. The courts have broad discretion in application of the law, in assessing your credibility, and in making findings of fact. There is no attorney in the world who can guarantee a specific outcome in any case, especially divorce (and to do so would be unethical). So what you’re paying for is the attorney’s knowledge, expertise, and experience as a divorce lawyer. Whether you hire an incompetent attorney is on you, but no attorney can guarantee you the…

Yeah but it’s true, you didn’t go to law school or pass the bar. And you chose to hire an attorney. Divorce is complicated and without a lawyer you would be worse off. Divorce lawyers charge the fees they charge because people like you are willing to pay them. An attorney who practices in the same courts regularly, knows the judges, knows the law clerks, knows the court staff, and has a professional relationship with opposing counsel is worth their weight in gold. You’re paying for the lawyer’s …

Unless your settlement agreement / judgment of divorce specifically address child tax credits (which it should, but you know better than me) you do not have to give her any of the child tax credit. If she doesn’t like that answer you should advise her to speak with her divorce attorney and if s/he feels she is entitled to half the credit than s/he can send you a letter so stating. You need to contact the equivalent of the “State Department” in Turkey and ask for assistance in the procedure. No one should get divorced pro se. But if the other party hire’s counsel that is your sign to hire counsel as well. Your 10+ years of separation may exclude certain assets from equitable distribution, but you’re still married for purposes of alimony until the date the complaint for divorce is filed (the “cut-off” date). If she hired an attorney the attorney isn’t going to allow her to waive alimony for no good reason. Obviously I don’t know all the facts of your case, but divorce is much more co…

Does your MSA define “cohabitation”? My guess is that it does not, and that’s your divorce lawyer’s fault,so have fun litigating the meaning of “cohabitation”. There is likely caselaw in your state that addresses “cohabitation” and you will need to meet that standard. I can tell you that where I practice law your attempt to terminate alimony based on “cohabitation” would be denied. The paramour stays elsewhere half the week? That’s a loser. Like any other marital asset. Legitimate businesses tend to be complex in a financial sense, and a business also provides ample opportunity for the owner to hide money within the business entity structure. Sometimes people will pay personal expenses out of business accounts (this is illegal but commonly done). I imagine there is not a custody order in place yet. But yes, OP needs to ensure that the drinking issue is addressed in court. The court will monitor mom if OP makes credible allegations and/or mom cannot rebut same. If the court finds that mom has a drinking problem she will not be given custody. It’s unfortunate because this is often devastating to a mother. Many are drinking because of their circumstances—not that that is an excuse for being a habitual drunk. Parental alienation is an issue, and to the extent possible it should be addressed in Court so that dad can enforce an Order which holds mom in contempt and/or monetary sanctions. Where is the data to back up the claim about new partners? Children are extremely adaptable to a variety of situations. They have more resilience than adults think. I am genuinely wondering what you think a better alternative would be? Should your ex not be able to start a new relationship? Should your children stay with your ex Sunday pm-Wednesday am and switch to you for Wednesday pm-Sunday am? This type of split 50/50 parenting is the legal trend. But there is something to be said about stability during the school week. Switching houses mid-week may become second nature to a child but it can also be a huge bump in their week.

Are your kids happy with mom? Do you think you should file for custody? Your situation is not the norm but it is not unusual either. Think of a bell curve. Most people fall into the middle. I understand your visceral reaction. It’s understandable. You should consider seeing a therapist to work through this specific life event. The bottom line is you need to come around to the fact that she did not cause this. You both are the reason your marriage is over. Psychologically she won’t have the guilt of initiating the divorce. You are the asshole husband that filed for divorce from your loving wife. Not having to pay the filing fee to the Court is not a reason. She will have to pay a filing fee to file an Answer to the Complaint. This is a well-written critique of marriage. While the male-female gender dynamic is generally true, I would remove that aspect from the discussion. There are men who marry women for their money. There are same-sex couples that experience the same thing. Marriage itself has changed so drastically, as OP explains, that it’s irrelevant who is participating in the marriage. All that matters is 1 person is in it for their benefit and the other is in it to their detriment (whether knowingly or not).

I don’t know if it’s verbal abuse. “Abuse” itself is a subjective idea. In a legal sense, “abuse” is both subjective and objective. Something might seem verbally abusive but whether it rises to the level of abuse such that society deems to be unacceptable and, thus, legally abusive is the general inquiry. 7 years together does not create a marriage. That is a myth that has no basis in the law. “Common law marriage” is a real thing in limited jurisdictions. These marriages are lawful in Colorado, D.C., Iowa, Kansas, Montana, Rhode Island, Texas, and Utah. There is no time requirement, like 7 years, but rather that a couple holds themself out to the community as a married couple, acts as a married couple, does everything an otherwise married couple would do, etc. It is fact-specific.

Yes, lawyers can and do craft aspects of agreements that leave the opposing party with nothing. (How do you think we have jobs?) But to really get a windfall is not the typical result. The typical result is that each party can live with the terms of the agreement. Neither party is particularly happy, but no one is totally outraged either. In other words, it’s fair. Unlike child support, alimony or spousal support is not based on a standard calculation or mathematical formula. Rather, alimony is based on the relative financial circumstances of the parties. There are factors that are considered but no single factor is more important than any other. And anything can be considered so long as the court believes it’s fair to do so. Well, first, I am not a GA attorney so this should not be understood as legal advice. But I am certain a GA court would engage in a similar analysis of all relevant factors. Notwithstanding a lack of income, another factor is whether the non-custodial party is voluntarily unemployed or underemployed with consideration to their education level, job training, and ot…

Child support is a legal right belonging to the child. Parents cannot contractually agree to limit or terminate a child’s right to financial support.
