As a gay male, I believe that this should have been prosecuted as if a heterosexual couple was broadcast without permission, with maybe a slightly stiffer sentence for outing the kid.

What this sentence does, is perpetuate that because two men were caught on camera instead of a heterosexual couple that the exposure was dirtier and more malicious.

Read the article. The guy who killed himself did not commit voyeurism. Displaying it on the internet for everyone to see was rather hateful. I am not surprised that it got upgraded to hate crime status.

The title of this post is misleading.

I disagree with this being a hate crime.

Instead, the act of spying on someone and displaying their sexual encounter with their consent should be punished near the level or rape, regardless of the sexual orientations involved. There should be no need to add more punishment to this action.
