I'm a female in my 20s who was brought into jail on a charge for the first time about 4 days ago. It was a simple battery misdemeanor because of a dispute with my former roommate. Nothing too serious (I didn't touch him, but he says I spit on him when it was really an accident during the arguement), but he called the police and took me in.
While I was there I was highly intoxicated. To make a long story short after I was booked and put into a uniform the officer gave me sheets and a blanket to put on my bunk before I got to the cell. As I said I was intoxicated and very cold, so I asked him for another blanket. This escalated, I got an attitude, and he and another officer threw me up against a wall pinning me there, telling me to "stop resisting". I wasn't resisting at all, but screaming for them to let me go as they were using excessive force.
They then threw me into a holding cell and proceeded to beat me. They threw me up against the wall again and I fell to the ground. During this I did not touch any of them. 3 more officers came in, still all male. I don't remember exactly what happened as I was intoxicated (I believe someone may have drugged my before the police arrived at my former apartment). The next thing I remember is still being on the floor and my pants being halfway down. I remember that this happened from the struggle and from being thrown against the wall, as the pants they gave me at booking were too big. One of the officers kneeled down and put his hand around my throat, then reached under me and felt my buttocks. I was still struggling at this time and yelled for him to stop. At this time he called me a "fucking bitch" and laughed at the other officers, a couple of which laughed as well. At this time I spit into the officers face (the one who touched me). He then punched me in the face five times and another officer maced me.
Now I have a felony simple battery for spitting at the officer. He also says that I cut his hand, even though I had nothing to cut him with. The police report for this is full of lies. They said nothing about the fact that he punched my five times. I'm assuming that if he did cut his hand during this then it was when he punched me, as I was wearing glasses with relatively sharp edges. I never saw my glasses again after that and they said they don't know where they are.
I have no witnesses, nothing. But of course being police officers they will all stand behind each other. I'm assuming there was no camera in the cell, because if there were they wouldn't be pressing charges in the first place, because what he did to me was illegal.
My bond was set low because the judge saw that I had a clean record before this day. Also I spoke with a lawyer and he says that because I was intoxicated I may have a chance of just getting probation or getting it dropped.
I was wrong for spitting, but it was a knee jerk reaction because i was beaten, touched, choked, and called a "fucking bitch" while on the floor by a bunch of men with guns... all while I was drunk.
Should I even bring this up in court? Like I said I've never been in any trouble before and I just want this to go away... But I feel like if I bring up the fact that he touched me it will just cause more trouble as I have no witnesses. What would you do? I can't sleep at night because I don't want to go to jail, but more than that I can't believe the police treated me that way and then lied about it.
I also have pictures of the bruises the left on my body. It's nothing too harsh, but it shows that something happened.
