Not a lawyer, but I think if you have a pending court case, you can file an injunction or something to keep her from moving out of state. I would talk to a lawyer for sure if you think her moving is a real possibility.

Are you currently active in your son's life?

Were you married when he was conceived?

Are you listed on the birth certificate?

How do you consider his Mother to be a friend, if you also fear that she would flee the state as soon as you file for joint custody?

Advice: document all the time and money you spend caring for your son.

If you had any custody rights, and the Mother moved away with your son, you could charge her with kidnapping or custodial interference. If you currently have no custody rights, then no.

Read your states statutes, they usually have sections dealing with removing the subject of the case, the child, once the case has started, which is usually post filing, not post hearing.

And don't fret, if you're friends then it probably isn't going to be as bad as you worry it could be.

Women in your position are instructed by lawyers to file orders of protection (merit is meaningless just lie) with the court and to take full custody of the child at that time. You have very little time to act. If she acts first you will lose.

Sometimes...and I mean sometimes...if you file papers for a divorce, the courts will mandate that neither can move out of state during the settlements. So, by that, you should probably talk to an atty. to get the facts on your specific state but I am pretty sure that she cannot move during the divorce. But, if she does indeed move, contact the local police department and file charges for abduction. Only thing you can do at that point.
