TFour: saying that a child’s welfare should be foremost does not negate the rights of the two parents. The appropriate action is one that preserves the rights of all involved through negotiation if at all possible. Only if a parent is a clear threat to the child should his or her rights be summarily abrogated.

While I thought this article was well written and argued, I have a problem with one of the assumptions hiding in this paragraph.

The issue of conflicts between a parent's rights and a child's rights is being raised.

I have a problem with that very concept (of possible conflict between the legitimate rights of parents and children).

I think the main reason parent's have rights with respect to their children is that it is in the interest of children than they do.

Parents' rights are a way of implementing children's rights. We start by assuming that, generally, parents give a shit about their children and would be better guardians than a randomly chosen person would. If we can't assume that, then soceity as we know it would simply not function. From that starting point, we then grant parents control of their children and we hold them responsible to provide for the chilren.

When one parent demonstrates their unfitness by abusing, then they give up any claim they have to a parent's rights to their child. There is no conflict of rights between the parent and child in that event.

If, as the article alleges, the father assaulted and hospitalized the mother while she was pregnant (and this was not trumped up bullshit, or perhaps self-defense on his part against her assaulting him together with a court system that fails to recognize female violence as existing) I think he should have had his parental rights stripped at that point and the adoption should have stood.

I think that was the first mistake the court made in this case.
