Domestic Violence by Proxy: four of mom's boyfriends have made threats, and two have attacked dad in public

A loved one of a father reported in a private Facebook group that in the last year and a half, the birth mother of his children has had four different boyfriends threaten to physically harm him, and two of them attempted to attack him while he was in public. Recently, her boyfriend posted on social media suggesting he would put the father in a wheel chair.

Here is my reply, in the hope that it can help other parents who are victims of domestic violence by proxy and who are seeking justice.

I am not a attorney and this is not legal advice.

This sounds like proxy domestic violence, with mom using her boyfriends as weapons.

Sounds like:

What Is Domestic Violence?

Does your partner ever….

Insult, demean or embarrass you with put-downs?

Stop you from seeing your friends or family members?

Make all of the decisions without your input or consideration of your needs?

Tell you that you’re a bad parent or threaten to take away your children?

All victims have equal access:

"No person in the United States shall, on the basis of actual or perceived ...sex..be excluded from participation in, be denied the benefits of, or be subjected to discrimination underany program or activity funded in whole or in part with funds made available under [VAWA]"

I would also consider a lawsuit for intentional infliction of emotional distress.

If mom is goading her boyfriends into attacking dad and his loved ones, it sounds like it may be depraved indifference.

To constitute depraved indifference, the defendant's conduct must be 'so wanton, so deficient in a moral sense of concern, so lacking in regard for the life or lives of others, and so blameworthy as to warrant the same criminal liability as that which the law imposes upon a person who intentionally causes a crime.

You describe social media threats to do bodily harm, which may be crimes:

Crimes of violence intended to intimidate and coerce are considered terrorism under federal law, see 18 U.S.C. § 2331, and the laws of many states, and threats to commit such crimes are not protected by the First Amendment.

https://www.law.georgetown.edu/icap/wp-content/uploads/sites/32/2020/12/Fact-Sheet-on-Threats-Related-to-the-Election.pdf

(c)Whoever transmits in interstate or foreign commerce any communication containing any threat to kidnap any person or any threat to injure the person of another, shall be fined under this title or imprisoned not more than five years, or both.

18 U.S. Code § 875 - Interstate communications

Possible violation of parental rights, consider a report:

The Civil Rights Division of the Department of Justice, created in 1957 by the enactment of the Civil Rights Act of 1957, works to uphold the civil and constitutional rights of all Americans, particularly some of the most vulnerable members of our society. The Division enforces federal statutes prohibiting discrimination on the basis of race, color, sex, disability, religion, familial status and national origin.

If I were you I would get everything in writing and consider speaking to a lawyer.

If the police are aware of these threats and attacks, and refuse to act to protect dad and his children, it is a possible cause for a federal civil rights action under:

42 U.S. Code § 1983 - Civil action for deprivation of rights

https://www.law.cornell.edu/uscode/text/42/1983

Victims of federal crimes may report them to the FBI.
