Hey /r/mensrights! I've finally had my first day in court. I had a temporary visitation hearing scheduled for the 19th, but the mother waited until 7/15 to retain an attorney. There was a "continuance" hearing today, and I found out about it this morning.

I commute an hour for work, and although my attorney stated I didn't need to be there-- I think it's important to be present at every court date.

In my initial petition, I asked for joint-legal custody, with her having physical custody. Every other weekend from Fri-Sun, and two nights out of every week. 14 days for a month. She's been begging me since the day she was served to drop the dispute.

I put nothing in there to slander her, at all. It was cut and dry. Her "reply" to my papers was this:

"The respondent, upon information and belief, asserts that in any hearing for temporary visitation that she will raise issues regarding the necessity for restricted visitation, including without limitation to the following:

A. The petitioner has in the past attempted suicide, is currently receiving psychiatric treatment on various prescribed medications for depression and has a history of self harm;

I've never, ever considered or threatened suicide. I am not seeking treatment for depression (I'm not depressed!), I am seeking treatment for a situational driving anxiety.

B. The petitioner suffers from frequent panic attacks;

I don't suffer from frequent panic attacks. I do panic when I drive on the interstate, though.

C. The petitioner is a 2 pack a day smoker and that the child has a medical condition which requires that he not be around anyone who smokes or be subjected to 2nd hand smoke.

I work way too much to smoke 2 packs a day. I smoke perhaps around 3/4 of a pack a day. My Son doesn't have any medical condition that would affect him. I would never, ever subject him to 2nd hand smoke anyway!

My attorney met with her attorney, and I now have a temporary visitation order in place, beginning Friday I will see him for 2 hours that evening, 4 hours on Sundays and 2 hours on Thursday nights.

Exchanges will be done at the local police department. I'm fairly surprised this is moving so fast. My attorney candidly told me that her attorney said his client, her mother, and her grandmother were unreasonable and that I WILL get unsupervised visitation, wether they like it or not.
