Yes I read it all and it's one fucked up ruling, though I agree with the sentiments of the result; you shouldn't be able to fire people just because they are gay; however this is fucked up as law. The court is acting as if it was the legislature.

Their reasoning is bizarre.

They say that a woman (say) who is fired because she is gay is sexually discriminated against because if she was a man in the same situation "sexually attracted to women" she wouldn't have been fired.

But common sense says that a man in her position would be a gay man accused of being attracted to other people of his own sex -- ie other men. And a gay man would be fired too. neither would be fired for their sex. Both would be fired because they are gay. And being gay is not a protected class of people in US law. Specifically it's not one of the five protected classes of the Civil Rights Act (race, color, religion, sex and nationality/ethnicity).

Of course as a communist I think being able to fire someone for ANY reason short of cause is wrong and the USA ought to enter the fucking nineteenth century and get some worker rights instead of living at the whim of bosses like slaves.

Here's an analogy of the USSC position on race:

Let's say a white person applies for a job and lists their race as "black" thinking it might advantage them in hiring. They get hired but then of course the boss finds they lied on the application forma and seeks to fire them. Is this racism against white people?

USSC says it is racism. Because a black person in the same situation (applying for a job and claiming to be black) would not have been fired for that reason.

And again the common sense position says this is absurd. The person isn't fired for being white they are fired for lying. The black person wouldn't be lying id they said they were black so of course they wouldn't be fired. it's not about racism. it's about dishonesty.

It's the same argument as the USSC makes for being gay. I should add btw that I am not saying being gay is wrong like lying is wrong, or that "trans people are lying about their sexual identity" as someone else who totally missed my point accused me today. Forget political sides and analyze the LAW.

This is bad law.

But it is a good result; but the Congress needs to do it not a bunch of judges.
