A father has his children the majority of the time while paying child support. He is afraid of filling out the judgment from trial, because he fears mom will abuse the legal system to drive his child and himself to homelessness.

I'm not an attorney and this is not legal advice.

Federal law requires child support in general to be set by formula, available via administrative procedures (without an attorney), fair, and subject to automatic withholding:

(2)Expedited administrative and judicial procedures (including the procedures specified in subsection (c)) for establishing paternity and for establishing, modifying, and enforcing support obligations. The Secretary may waive the provisions of this paragraph with respect to one or more political subdivisions within the State on the basis of the effectiveness and timeliness of support order issuance and enforcement or paternity establishment within the political subdivision (in accordance with the general rule for exemptions under subsection (d)).

(B)Procedures under which all child support orders which are initially issued in the State on or after January 1, 1994, and are not being enforced under this part will include the following requirements:

(iv)Withholding from income of amounts payable as support must be carried out in full compliance with all procedural due process requirements of the State.

You appear to fear retaliation for caring for your daughter and asking for what is right.

If the agency is punishing dads and their children for asking for corrections to child support or allowing moms to do the same, and aiding and abetting theft of family income illegally due to sexism, it may be:

The fact pattern you describe suggests they they have devised a scheme or artifice to defraud or embezzle from the children the support they are due, a federal crime:

(a)Whoever, if the circumstance described in subsection (b) of this section exists— (1)being an agent of an organization, or of a State, local, or Indian tribal government, or any agency thereof— (A)embezzles, steals, obtains by fraud, or otherwise without authority knowingly converts to the use of any person other than the rightful owner or intentionally misapplies, property that— (i)is valued at $5,000 or more, and

This sounds like mom may be engaged in financial abuse of dad and kids, a form of domestic violence, and if the agency illegally aids and abets that domestic violence, it may be a federal crime.

Dad has a fundamental right to raise his children. Failure to reasonably enforce child support prevents him from using family resources to support them, and likely prevented him from providing for his kids in the manner he wished. For example, he perhaps was unable to provide for them the vacations they deserved, or give them extra tutoring or provide them money for sports, camps, and other activities he would have otherwise done if he had these funds.

"There is a fundamental right under the Fourteenth Amendment for a parent to oversee the care, custody, and control of a child."

A deliberate failure to enforce mom's child support obligation is a possible criminal conspiracy against rights:

"If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or"

If the agency allows mom to terrorize dad and his child by threatening them with homelessness through complaints in order to aid and abet her theft from the child and dad, they may be active participants in:

Extortion

Forcing action or obtaining something by illegal means. Anyone may commit extortion through force or coercion. A public or private official may also commit extortion under the color of office.

WHAT ARE SOME EXAMPLES OF CLASS-ACTION LAWSUITS?

There are many cases and issues that can be brought as class-action lawsuits. Often, class actions fall into one of the following categories:

As a consumer of agency services:

Consumer: These class actions hold accountable business entities who engage in systematic and fraudulent or illegal business practices that scam or harm the consumer. Examples include antitrust cases like price-fixing, market allocation agreements and monopolistic schemes.

General civil rights:

CIVIL RIGHTS CLASS ACTIONS:

A SINGULARLY EFFECTIVE TOOL TO COMBAT DISCRIMINATION

For over 50 years, class actions have been among the most powerful tools to secure civil rights in America. Brown v. Board of Education, 1 which outlawed school segregation and set the stage for the entire civil rights movement, was a class action lawsuit. More recent examples include the case portrayed in the Hollywood movie “North Country,” based on the case Jenson v. Eveleth Mines and considered to be the first sexual harassment class action lawsuit.
