It's obvious to everyone here that the current set of laws in most developed countries regarding custody, alimony, and child support, is simply wholesale systemic child abuse. By permitting women to leave a husband and father for whatever reason they want, and spend large %es of his income and wealth however they want, the regime strongly incentivizes divorce, and has significantly contributed to the continued rise of boys being raised in single mother households and the resulting men's mental health epidemic.
That said, let us consider two hypothetical women, whose concerns are also valid:
1) A woman may wish to be a stay at home mother, but without any legal regime of financial support, is concerned that by leaving the workforce, she opens herself up to the possibility of the man leaving her for a younger woman later, effectively stranding her.
2) There are also good women who do and intend to continue working and want a family and also have no intention, if/when the relationship with the man ends, to use the law to steal the man's money, and even turn down legal aide's pressures to do so. Unfortunately, some of these women may have trouble finding partners, because of the legitimate fear that men could have that they are not one of the good ones.
So I would propose the following: a two option system:
1) "Equal" Marriage: the expectation is that both parents work. You have the legal rights associated with a marriage and possible children. If the union ends, there is zero transfer of money between any adult and, barring proven situations of child abuse etc., custody is always 50/50 (Essentially the law in effect in Sweden, as far as I understand) and so there is also no need for child support.
2) "Division of Labor" Marriage: Under the assumption that one person foregoes employment, there is spousal alimony and child support (with possible stipulations as to how it must be spent) and custody is more flexible. However, divorce CANNOT be done with no fault. Fault must be proven in a court of law in order for there to be any access to the alimony and child support.
What do you think? Seems fair and sensible to me
