So because some women in the US are like that it means that all women are never held responsible for their actions , in any country , ever ?

[–][deleted] 0 points1 point2 points 11 years ago (0 children) | Copy Link

No, but it's a direct example where a legal jurisdiction has a premise that allows them not to be held responsible for their actions in a specific circumstance, I just never saw such a direct law before.

Personally I think nobody should be punished for taking illegal drugs if they don't have kids, but regardless, rape is objectively worse than drugs. It's like when the cops give drug users immunity if they rat out the dealer. Just a matter of priorities.

Right, when they rat out the dealer. This legislation only involves those who report sexual assault, whether or not it really happened or have any proof.

Yeah.. they're essentially "ratting out" the rapists. Whether or not it happened or if they have proof is up to the police... just like it is when busting possible dealers.

First of all, there's literally nothing in that article that implies that men and women would be treated differently. Secondly, absolving people of a past crime in order to get them to report a different crime isn't the same as getting "the free privilege to commit other crimes". You know how you can get a reduced sentence by cooperating with the police? Is that them giving criminals the "free privilege to sell drugs"?

First of all, there's literally nothing in that article that implies that men and women would be treated differently.

The vast majority of those who report sexual assault and rape are women. It wouldn't treat men differently, but they are statistically insignificant here. It's like saying both Jews and Muslims would be treated equally under a law in a country where 99% of the country is Muslim.

You know how you can get a reduced sentence by cooperating with the police? Is that them giving criminals the "free privilege to sell drugs"?

This is not about a reduced sentence. This is complete immunity. A girl or guy can go around, take drugs, that are illegal and report sexual assault, whether it happened or not, and not be charged for taking the drugs. People are in jail for taking drugs. Why should these college girls get immunity from crimes others are held responsible for?

It's like saying both Jews and Muslims would be treated equally under a law in a country where 99% of the country is Muslim.

Well yeah. If you made a law saying "you have to wear a seatbelt" then it would treat jews and muslims equally, no matter the demographics of the country or the ratio of either religion who own cars.

A girl or guy can go around, take drugs,

Why should these college girls get immunity from crimes

You missed the part where guys can get the same immunity

This is not about a reduced sentence. This is complete immunity.

Right.... and I'm saying that this is nothing new.

Witness immunity from prosecution occurs when a prosecutor grants immunity to a witness in exchange for testimony or production of other evidence. It is immunity because the prosecutor essentially agrees to never prosecute the crime that the witness might have committed in exchange for said evidence. In the United States, the prosecution may grant immunity in one of two forms. Transactional immunity, colloquially known as "blanket" or "total" immunity, completely protects the witness from future prosecution for crimes related to his or her testimony.

Sexual assault is a much bigger problem than a college student taking drugs. If they were manufacturing or selling drugs you might have a point but who cares about individual use?

Post removed, title is not neutral.

A male coworker of mine recently got into a car wreck. He was speeding. A cop was right there when the accident happen. The cop didn't give him a ticket and helped him off the road.

Personally, it can't get more blatant than this.

This is not blatant. It's a trade off to focus on something that is perceived to have more importance. It's either rapists get held responsible for their actions or drug users for their kick. I rather have rapists in jail when proven guilty.

There are unintended consequences to every law. I'm worried about women making up that they were raped when they get caught with drugs.
