This is why is the US we have a specific estate planning technique. When I teach new accountants about estate planning this is the sort of example I use (well, I use "the tennis coach") to illustrate why the QTIP trust exists.

Any time the wife is not the mother of all the children we insist on QTIP trusts. In recent years I recommend them for every client even if the man believes all of the children are his. keep honest people people honest. lol.
