If all humans are to be treated equally, but one group isn't treated as such by society, does society consider that group human, or something less than.

"Hypocrisy is above betrayal and below everything else."

If group A does crime 1. they get X punishment.

If group B does crime 1. they get Y punishment.

If X does not equal Y then one group is being discriminated against. This is fact. (whether its a positive outcome or negative)

So if all humans are to be treated equally and one group is not, then they must either be A. not humans, or the enforcer is a hypocrite, and if the enforcer is responsible and accountable for maintaining equality, for justice is blind, then they are also the worst, a betrayer.
