If both parties were drunk, the rape case and argument doesn't hold up unless it is clearly obvious the guy or girl has been assaulted. The "She didn't know what she was doing and isn't responsible" argument is bullshit. If the girl was drunk and drove a car subsequently injuring or killing people, does the "she didn't know what she was doing and isn't responsible" argument still hold up? No.
