TIL: Two doctors get divorced. Man gets primary custody of their 4 year old. Woman gets pregnant by Chad after the divorce and moves in with him, files for primary custody so that "the child won't miss the new step-siblings and half-sibling".

Man is demonized for viewing pornography, going to Vegas once a year to gamble and having a 24 year old girlfriend (while he was 35).

Woman also claims she experienced "gender and personal bias" so she is appealing to have primary custody.

Marriage sounds fucking awesome!

Parties married in 2004. Their child (E.R.T.) was born 2006. Mother filed for divorce in 2009.

Both parents were physicians and lived in the same city at the time of divorce.

E.R.T. spent equal time with both parents but father had primary residential time.

Less than a year after the divorce the mother was unmarried, became pregnant and moved 2 hours away and became engaged to another man. Mother filed a motion to take E.R.T. with her and have primary residential time.

Mother's motion was denied once. Mother appealed and denied twice.

Mother appeals again claiming "the decision resulted in a divided residence" because:

The new man she married has kids. She also gave birth to the new man's child. The mother claims having E.R.T. stay with the father would create a "divided residence" because then E.R.T. would be away from step-siblings and half-sibling.

--- Fucking bullshit. A woman can fight for sole custody and move far away just because the new guy she is fucking has kids and she has an infant with new guy too? ---

"The mother and her nanny both testified that E.R.T. had quickly developed a bond with the other children in the mother's new home". (who would have thought that paid help would be in agreement with the person who writes their checks?)

"mother contends the judge made comments during a motion hearing 8 months before the trial that reflected anger and bias towards her, and the judge "exploded" at her attorney in chambers at a pretrial meeting".

"She also points to comments and evidentiary rulings made by the judge during the trial and in its subsequent journal entry that she believes reflected a gender and personal bias against her."

She's told to fuck off by one judge because she waited until the trial was over to claim bias instead of during the trial. "You can't roll the dice waiting for the trial's outcome and then seeking reversal if it is not to his or her liking".

One other judge dissents:

"The mother focused much of her attention on her exes morality and choices, specifically his predivorce weekend with a young stripper, his gambling tris, and his viewing of pornography. The mother claims a double standard of morality that she was judged for being unmarried and pregnant by a man she had not known for very long."

Father's computer was scanned and "recovered almost 11,000 pornographic images and files on his laptop that included nudity and all types of sexual acts".

"These facts might be discounted by the court in deciding a divorce, however they are relvant when deciding custody of a 4 year old child".

"The mother should have custody because she has many relatives close by: mother, brother, sister, sister's husband, nephews with two small children, niece and husband, and another sister and husband with twin boys". Meanwhile the father has a mother he sees every couple of months, a half sister he sees once a year and a 24 year old girlfriend".

Appeal continues from what I can gather.
