I don't know about how it went down in Canada, but here in the U.S. the federal courts made the biggest power grab in their history, without even having to offer any justification. In a few years, when some of these surrogacy/adoption/sperm donor cases turn into custody disputes, and then into disputes over how presumption of paternity can possibly apply to a same sex couple, then no matter what a state decides, the losing side will have a federal issue to appeal. It won't stop with paternity. A generation from now, the federal courts will control every family law issue. They stayed out of it for two hundred years, and now we handed them the whole thing because we were scared somebody would say that we hate gay people.
