PORTLAND, Ind. — A Portland woman this week admitted to sexually abusing a child.

Misty R. Smith, 39, pleaded guilty in Jay Circuit Court to child molesting, a Level 3 felony carrying a maximum 16-year sentence.

When she was arrested in July 2019, authorities said Smith had engaged in sexual conduct with a child under the age of 8 years old. Court documents indicated the victim as a result had contracted a "dangerous sexually transmitted disease."

A plea agreement reduced the charge against Smith from a Level 1 felony, carrying up to 40 years in prison, to a Level 3 felony.

It leaves the length of Smith's sentence up to Circuit Court Judge Brian Hutchison.

"However, the state will stand silent (on that issue)," the document said. Smith will be required to register as a sex offender in the communities where she lives and works.

Hutchison set sentencing for Aug. 27.

The plea agreement had asked that the Portland woman not be sentenced within 30 days of her guilty plea, as is common, to give her time "to get her affairs in order, specifically by paying off her home mortgage."

Court records reflect no prior convictions for Smith. She had most recently been scheduled to stand trial on June 30.

Why is this a pussy pass situation? It's not uncommon to get a reduced charge if you accept a plea deal.
