Just because you live in a state where lethal force is authorized, there are still rules you have to follow. You have to shoot her dead or immediately call her an ambulance if she survived the shot. The guy is going to jail because he left her to die
She committed a very stupid crime and you'd be 100% justified in using your legal right to defend your property. Just follow the rules or you will still go to jail. The way in which you can use lethal force without punishment is very sensitive to the details.
