What is Title IV-D?

>The Social Security Act of 1975 contains Title IV-D—a federal law that, in part, requires every state to manage a child support enforcement program. To help fund these programs, the federal government provides money to each state. These funds help cover the operational costs involved in child support enforcement—including establishing orders, enforcement efforts and tracking and reporting.

>While the federal government provides most of its funding for the child support program through matching payments to reimburse states for their expenditures for allowable expenses, it also makes incentive payments to reward states for strong performance on a range of measures, such as cost-effectiveness. Section 458(f) of the Social Security Act allows states to use their incentive payments to either “carry out the State plan” or “for any activity (including cost-effective contracts with local agencies) approved by the Secretary, whether or not the expenditures for the activity are eligible for reimbursement under this part, which may contribute to improving the effectiveness or efficiency of the State program operated under this part.”

The Family Court Judges, attorney ad litems, psychologist benefit from Title IV-D funding. The funds are given to the states on collection of child support. There is no incentive to grant the "best parent" custody - but to examine which parent can pay child support. This is important as every dollar of child support collected is matched by Title IV-D funding. The funding going to the States are not used to enforce visitation rights of the non-custodial parent but going into areas of the State that are not accounted for.

This also accounts for the rate in which most non-custodial parents’ rates are raised, this in turns makes the amount of child support collected increase, bring the cycle full circle and padding the governments pockets once again no directly. This simply incentives judges to levy child support payments on the basis of most child support that can be ordered for each case.
