I have argued with people about this several times, and have never seen anyone even consider it a sign of even possible bias.

Often, this point will be dismissed out of hand, something to the effect of: "Yes, but men don't actually try to get custody, so of course it goes to the mother!"

Then you admit, hey, yeah, I am sure some guys do that. But what about the guys who do fight for custody?

"No bias, because men get about 50/50 custody in those cases."

Yeah, they often conflate or combine "gets custody" and "gets to have some custody". When some can mean every other weekend. 50/50 custody would mean both parents get the kids 50% of the time, not only in 50% of cases. Both are problems.

But anyway... good luck getting that through.

One I argued with a few days ago dismissed an American study out of hand, so I reviewed a Canadian child custody study and loved it. They put a lot of information in there that you don't usually see in US studies.

In it, they broke down custody into contested and uncontested. Even in contested cases, fathers received primary custody in only 2% of cases. Mothers in 20% of cases. The rest was some sort of shared/joint or other.

One thing I loved was the agency only considered it "shared" custody when both parents received at least 40% custody.

In the US, 90/10 can still (loosely) be considered "joint".

Anyway, after pointing that out, radio silence. People will be happy to tell you how wrong you are all day, but if the data doesn't match their confirmation bias, they shut down and leave. Too much cognitive dissonance must make their head start to hurt.
