My brother received a petition for custody from his ex girlfriend (together for 6 years). In that time they lived together, shared a bank account and got a house. However the house was only in her name, they only paid off her debts, the cars were in her name, she filled her taxes as single as she had two other children from previous relationship. He had to leave the home after she filled a report on him. He was only able to take what was his before they got together - nothing they bought while they were together. For the most part that doesn't bother him since he wants his kid to have things.
Anyways I tried my best to write a response for my brother that sounded correct based on what he wants. I am no lawyer thought and he nor anyone in my family can afford the 1,500 down payment for one. All he wants is 50/50 for legal and physical custody. He lives within walking distance to her house so sharing shouldn't be too difficult. Financially they are about the same but with her earning a bit more. They can equally provide their half. She is filing for sole custody we believe in order to get the child support money.
He has no idea how to present himself in court - I have an idea but I am not really sure either. He knows to be polite and answer all questions etc.
Any helpful link would be most appreciated as I try to help him navigate this. We reside in Iowa.
