So my ex wife, of nearly 10 years, lied to the court and said that I owed her money that I had already repaid. So over the course of 15 months and several 1400 mile round trips (12 of them) I went to court. Most of the court dates got railroaded by her attorney and I completely wasted my time. On the final court date, I had a hearing. During that hearing, she never mentioned the money I "owed" her. No biggie my attorney thought, because if the issue had not been heard by the court, they cannot rule. The court had my argument summed up in an objection that had the cashed checks attached to it.

Guess what. They found that I owe her the money I had not only already paid her (5yrs ago), but had cashed checks to prove it!

My options are, from what I understand, to appeal or pay her.

Is there an option to pay her and file theft or fraud or any type of criminal charge? She is essentially strong arming me, and stealing money from me if I pay.

My attorney doesnt handle appeals. I have spent tens of thousands of dollars dealing with this vile woman. I just want it to go away, but I do not want her to get the satisfaction of taking my money.

So far my plan is this: Email her the cashed checks showing that the money has already been paid. Ask her to sign something saying the debt has been satisfied. File a motion with the court to satisfy the debt. If she objects, go back into dealing with the court again and again.

Or, can I pay her, and have her criminally charged? And hopefully get my money back through restitution?

Or... Does anyone know a good attorney in the 11th circuit of appeals in Ohio? My (current) wife is an attorney and is a wiz at legal writing. So I hope I can get a break on the price. Also, she is going to reactivate her license in Ohio to be part of the team.

Im so pissed off. I just got the news today. I thought this mess would be over. The story is such a long one, I have thought about writing a book.

Long story short is this, and its not too bad. Wife left me, we had shared parenting. Wife started using drugs. I motioned to be the parent for school purposes. Wife made abuse allegations against me. I spent 9 months visiting my son supervised for about 2hrs a week. Got CPO dropped. Got to be parent for school purposes. Wife kept fucking up. Got full custody. Couldnt buy a house because wife never took me off the loan, and it went into foreclosure. Said fuckit and moved to Iowa (with permission from the court). Now wife just motions for BS to make me bleed money in attorneys fees and travel expenses.

But I do have custody, so thats a plus. But if she misses a call to him she takes me right back to court. FML.

Any input is appreciated. I need to know all of my angles on this.
