The presumption of guilt is enshrined in America too, of course. The police do this on the front end because they know they will lose on the back end, that is, although they know they don't have enough actual evidence for a conviction, they will still make your life miserable out of a presumption that you are guilty. You still need to be proven guilty beyond a reasonable doubt at trial, but before then, the police are allowed to do whatever they want to.

For instance, the police can use evidence to charge you for a crime that they know will be excluded at trial. Which doesn't matter anyway, as most statutes for sex crimes don't require corroborating evidence, anyway. So you get arrested, then sweat for months awaiting trial, either in jail because you can't afford bail, or at home unemployed because of course your employer doesn't want a rapist at work. The police make your life hell before trial intentionally, out of the hope of forcing you into a plea bargain, because they know they can't win at trial. And a lot of people don't want to risk trial, knowing that the punishment will be that much worse.

The author is right, it is a huge disservice to the presumptively innocent. The police ruin lives because they know they can get away with it, and to them punishment before any sort of conviction is justice.
