This might just be the result of poor translation, but I'm like 99% sure the judge was saying that the woman should be charged with a serious crime because the men had to stay in jail until the original rape charges went to the argument phase in court, not that the men will remain in jail as the woman is charged with filing a false claim.

Sounds like the judge is 100% in the right here to me.
