In Massachusetts / we had one day of trial last week and going to day 2 next week with STBX testimony and witnesses.

Still living in marital home since filing in May of 2017 but STBX has become even more difficult to live with after day 1 of trial saying judge was laughing and falling off her seat at my testimony and my witnesses testimony. Saying most ridiculous thing judge ever heard. I seriously don’t think her lawyer has told her this. She also walked out 2x. while I was testifying about the disciplinary problems we had with her son. Clearly the judge saw that she walked out.

I have been staying at friends house till day 2 of trial next week.

If the judge knows that the living conditions have become unbearable will she make a judgement for my spouse to move within 30 days if she knows about her harassment and I agree to start paying alimony immediately before final judgement is signed? Just don’t know how that works.

Also STBX moved out for 3 weeks but since has come back. If she is complaining about me what would make her move back? That doesn’t look good and contradictory on her part.

Met with my attorney yesterday explaining the situation but we are really preparing her testimony questions and I told my attorney she is going to have to be a pitbull. My attorney seriously doesn’t think that the judge is going to fall for the “He forced me to quit my job story”. I said in testimony that I advised her to look for another job in the company. I did not tell her to resign. She did that entirely on her own and even said in her deposition she was highly stressed. But now her story is he said he would take care of me! She has contributed nothing to expenses for the past two years slowing pushing me into paying cable and utility bills which were in her name.
