I live in another state currently and have maintained a joint account which 97% of my income goes into. I have a solo personal account which the other 3% goes into. Until recently we have basically been separated but nothing legally. Co-parenting sharing of the 97% of my income plus the small amount she makes etc without HUGE issues. Recently we fight more and more, ignore each other for long periods of time and recently she threatened to withhold my child from me. As such I can delay any longer and will be proceeding towards divorce soon.

I have no intent of hiding anything from the court or not giving her what is owed upon the divorce however recently she has been spending roughly 3x the amount each month that she had been prior. My concern is not having enough left over for attorney and court fees.

At which point is my weekly paycheck not considered martial assets and I can put 100% into my personal and provide a fair amount for support of my child? Is that once I've informed her that I will file, is it once I contact the attorney, is it once the paperwork is actually filed with the court, or is it not until the divorce is final? For reference State that divorce would be filed would be Kentucky.
