This is troubling.

It sets a precedent for other crimes which could be impacted by this ruling.
Anyone remember the Duke Lacrosse case? One of the accused was on an ATM camera miles away during the alleged incident, which helped exonerate him (despite DA Nifong's assertion to the contrary). If this passes, it would be up to a judge's discretion if electronic evidence is admissible, including texts, emails, social media. But, unless I misunderstood the article, only for the defense!

So the case of Emma Sulkowicz, for example, there was a flurry of texts after the alleged incident which likely spared the accused student any criminal prosecution. In this Bizarro legal world that's being proposed, he'd still be locked up.
