There is a lot of bias in family court towards the mother. Why is a somewhat more complicated issue but it is related to ideas that women are better parents, and also to feminist who have fought against things that would make it more fair for men.

Yes, custody hearings are often slanted towards the mother, due to stereotypes that women are better parents and nurturers and such. I think, not having seen the full movie, that Dustin Hoffman's character should have received custody of the child. Better to leave the child with an emotionally and mentally stable, consistent father than a mother who had left the family and had just returned from therapy. If the genders were reversed and the father was the inconsistent one who left and argued that he should have custody of the child because "he was his father", the decision would have certainly been in favour of the mother.
