Because you're probably her best option right now. What if she suddenly perceives the other guy as better or someone else comes along?

Not overtly.
She communicates that she does not want your commitment. If she wants it, she has to prove she's worth it. If she was, she'd have told the guy to fuck off.
The solution is simple - plate or next. She's holding onto plan B's, you can do that too.

He shouldn't have apologised. He should have held frame when she shit tested him.
I don't think you have anything to worry about. He initiated the conversation and she shut him down immediately.

There's a reason she's your ex, but you seem to of have "forgot" that.
If you left her once, it's obvious (in my opinion) things will likely not work out again. I wouldn't put too much investment in this, and use it as a fun time/learning period.
It's obvious this guy sucks, so take it as a chance to pat your ego on the back. But like the other poster stated, she is likely to branch swing and if the chance comes up, will likely take it.
So stay distant, have fun, and be willing to take risks to try out new ideas you have on her for future use. Shes a temporary fix, not a place to setup base camp.
