Because regardless of the legality, a lot of people have drugs intimately involved in their sexuality. And so by this definition, a lot of frankly normal behavior becomes criminalized. Just part of the general "everything is rape" trend. "If she isn't enthusiastically consenting vocally every second, you're probably raping her." Up next: "If at any time before, during, or after she decides she doesn't want it to happen or she doesn't want to be responsible, it's rape."

Quite similar in my mind to the "nagging is rape" argument, which is also present there subtly.

Also, you say "drunk". The argument is often extended to any alcohol consumption, which goes beyond (current) legal standards. After all, any impairment is impairment, right? Better safe than sorry, right?

So...extend it. Sleep deprivation can impair judgement. So can certain nutritional deficiencies. Can a person (woman) claim rape if they didn't sleep well the night before or missed their vitamins? Is a person (man) also responsible for making sure their partner is well-slept and fed along with sober? etc. etc. etc.

It's a hot button issue because the vast amount of missinformation behind it. Getting a rape case based entirely around alcohol is rarely going to stick. Alcohol is only a useful defense when you are at the point of where you can not possibly make a reasonable decision, for instance, near black out drunk or barely able to walk. But if you're just plain old fashioned drunk, you wont get any DA or jury to bother with claiming it was rape entirely because she/he was drunk. Making a bad decision when drunk is one thing, it's another thing when you are so drunk you can't even stand.

If being drunk completely exonerated you from any legal liability, executives would just show up to every contract signing drunk so incase they ever needed to nullify the contract, they'd be able to get out of it.
