In Chile feminism has quite a bit of influence, the ministry of women and gender equality (that's right, they granted themselves the authority to represent equality) make campaigns focusing solely on women and feminist lies, always with anti-male speeches that go unnoticed because they take special care to dress everything with a narrative of social justice.

Already for a time they've been using a new made up term that suddenly all have automatically started to use in TV and media, which is “gender-focus” or “gender-approach”. It basically means special treatment for women and men are bad first.

In this new a woman who nearly killed her partner was acquitted after being convicted, this time because they used a “gender-focus“ approach to consider her case.

In this case they decided that a woman can actually stab a partner and be judged with different rules because she is woman. They call that a “gender-focus” approach.

Court of appeals of Antofagasta acquitted a woman who had been convicted of attempted homicide against her ex-partner.

The court took into account the brutal attacks she suffered for a long time and, using the gender-approach, it considered she act in self-defense.

Narrator:

Gabriela just got out of jail, she is still very scared so that's why she tells of the attacks from her ex-partner with her face hidden.

Gabriela:

“He once told me if you aren't going to be with me you aren't going to be with anybody”

“He some times would hit me and I didn't say anything, I also didn't... my [female] friends told me... I wouldn't listen to anybody only to him.”

Narrator:

This Bolivian woman who settled in Antofagasta suffered systematic violence and lived in permanent risk for about two years. Until in October 2019 she “defended herself” with a knife after an argument.

Gabriela:

“He came and took me by a hand, and we started a struggle, and during the struggle... well I don't know if during the struggle but the thing is that he got stabbed”

Narrator:

The man survived, she was put in preventive prison.

Starting June of this year the court convicted her of attempted murder, but the court of appeals of Antofagasta considered that Gabriela was just trying to save her life.

Éric Sepúlveda, president of appeals court of Antofagasta:

After analyzing the facts, and from a gender-approach, we concluded that there's a current and imminent aggression, which thusly fulfilled the prerequisites for a self-defense.

Mario Fuentealba, chief of studies of penal defendants:

This is a very relevant verdict because it recognizes, for first time, we believe, the gender-approach in acknowledging reasons for self-defense.

Narrator:

There are similar cases like Karina Sepúlveda who in 2013 was acquitted from parricide after two trials against her, after shooting the man who attacked her for 2 years.

But here the woman was acquitted because of “state of necessity”. Gabriela was acquitted for acting in self-defense, making it an unprecedented verdict.

Mónica Zalaquett, minister of women:

A woman who's been suffering violence for more than a decade is in a complex state of vulnerability, when one talk that we need to incorporate the gender-approach in different aspects o life, it's to acknowledging there are differentiated situations that, for us to balance them, we need to incorporate that gender-approach. And that's what the courts did this time.

Rebeca Zamora: UCEN academic in penal law:

The court took into consideration the facts of how these events of violence happen in a family, how the violence between partners happens, how hard it is for women, many times, to denounce.

Narrator:

After almost 2 years detained Gabriela got free last weekend.

Gabriela:

“They don't feel bad for you, but when you are in love you don't see reality”

Narrator:

A verdict with gender-approach that changed the life of Gabriela.
