Relationship was consensual but it was obtained on the false pretext of marriage, hence it's a rape case. There so many such anti men and anti logic clauses in Indian penal code. Conviction rate for rape cases in India is less than 30% . But that doesn't come in the news. Every time a rape happens it's sensationalised in my country and always a knee jerk reaction, recently 4 men were arrested for raping and killing a woman but they all were shot after they were tried to escape and that's what the police said. Well now an inquiry by human rights commission report submitted to the high court of the state says that they did not try to escape and it was a false narrative y the police because police killed them so they could close the case. No outcry fro this from so called international human rights bodies or feminists.

Indian Supreme court has given out a statement that sex on the pretext of marriage cannot be considered Rape. Consent cannot be withdrawn. So this situation will likely get a lot better with time.

I agree though, that many have already suffered because of orthodox judges who sympathised too much with women, but no more!

I notice that most of the cases that are called rape or sexual assault in western nations would not be illegal in most countries. Sometimes because they are only illegal due to a small difference in age, sometimes because they are completely consensual, and sometimes because they never actually happened. Many of those situations involve questionable moral conduct, which should not be discounted completely, for either the man or woman, or men or women. But when western media equates them to rape, it makes the condemnable crime of rape meaningless.

In fact, you always find in those nations that when there really is a psychotic rapist on the loose, the media makes every effort to cover it up or to downplay it, because it does not fit their narrative that the mainstream respectable men in their community are the ones committing these crimes.

If the guys you describe were really guilty, I'm not sure I see a huge problem with killing them, I would just be worried that they were not certain they were the ones who did it. I can see why they might have had no confidence in a court sentencing them, depending on circumstances. They let the worst criminals go in western nations, so I can see how it would happen elsewhere.

Your last point is concerning because the trial never happened they were in judicial custody and brought to the palce were scene happened suspiciously at early morning and then police report to the public that they have been shot dead because they tried to escape. Everyone cheered for it. It was a knee jerk morality type of thinking which causes all this. One year later high court probed this shooting and now found out that they didn't try to escape and police killed them intentionally. And if this happens with every man who was accused of sexual misconduct then it's really not justice but just a reaction. And feminism is already doing that.

I agree, except that the details you describe make it different than a random accusation. First, the fact that they killed her makes it certain that it was not just a fake rape accusation, because even if she were promiscuous, she would not consent to being killed. Second, the possibility exists that they could have made a mistake and accused the wrong guys, but in the case you describe, they would have had access to DNA evidence, so that could have (assuming it was utilized) determined for certain whether it was them. And last, the crime would at least merit the penalty of death, if the really were guilty, so it's not like this was just a witch-hunt over mere allegations of misconduct. But I agree it is a bad precedent, because lynch mobs are well known to get the facts completely wrong, and when there is a serious crime, witnesses can make up an allegation against anyone they don't like. Hopefully, they had conclusive evidence, and they didn't just accuse the first guys that someone pointed a finger at, without evidence.

This is kind of justice is quite common in developing nations and particularly in India if it's related to women then white knights go bat shit crazy. The fact is that they were not killed by some random mob of feminists but the ones who should uphold the justice which is very concerning. They didn't even investigate them properly. They arrested those guys on suspicion and next day they were shot dead while under police custody. The wrong doing should be proven beyond reasonable doubt which clearly didn't happen here.

Adding to this: India has some of the most unequal and imbalanced gender based laws. 1) There’s something called as “violation of the dignity of a woman (or something like this),” many things in this law are vague. It doesn’t define anything. If you got into a quarrel over something with a woman in public, you can be charged with it.

Eve teasing is the purpose behind the law, and I absolutely abhor the clowns who indulge in that sort of a behavior. However, in many cases people have been charged under that law even when there was just a quarrel and no Eve teasing was involved.
