There is no presumption of equal time and in fact, case law here dictates that once a matter is litigated, it is inappropriate to order joint custody unless the parties agree. The child support will keep me from getting my own home and having to live with my parents at almost 40. Again, if she earns more than I do and is comfortable, im hoping the court won't be hellbent on seeing me homeless just to make a point. Who knows. Assuming the home is marital property, if you move out and find other accommodations, you are telling the court that you don't need the home and can afford other accommodations. This makes it more likely your spouse will get the house in some sort of distribution of assets. As far as thr children go, you're going to argue that the kids are your life. The only reason I'm not home with our son now is because my wife is there with him and made it difficult for me to be there. I don't want our son to see tension all day so I go to the office while she works from home during this pandemic.
