How is parenting time decided by Supreme Court during a divorce proceeding? Equally involved parents. Both work similar work schedules. Mother earns more than father. Mother wants 70/30 parenting time. Father only requests 50/50. Father, mother and child continue to live together during proceeding. Any insight would be appreciated.

Father should request 70/30 in his favor.
Likely that judge will meet both of you in the middle, and the end result is 50/50
Most of it depends on the age of the kids. a bit older and 50/50 is more likely

I wonder how the GAL makes this recommendation. Its a very nuanced thing. For example, she could say "i read our child a bedtime story and put him to bed every night." I can say AND prove that prior to divorce, I handled that responsibility and since divorce began, mother has refused to let me do so. She could say "I do our child's laundry every week." I could say AND prove that I soley did this for years until divorce began at which time mother told me not to do so and placed a security lock on the laundry room after I didn't comply. Mother could say "father never went to a dental appointment." I could say that's true, but I always wanted to go and she told me not to AND I can prove that after divorce began mother agreed that father would attend and then lied about the appointment date. Father had to find out real appointment by calling the office. Notwithstanding, I still have a good case but things like this must come to light.

I understand. I would only assume the information is relevant in terms of how her behavior affects my parenting. I wouldn't want them to think oh look, mother does all this but not understanding why. If that should happen then my wife's tactics would be successful and that would be a great disgrace. If they ask me who puts your child to bed at night on most evenings, how do I answer that? Do I say oh my wife does that? Do I say I primarily did that until January 22nd, 2020? And if they ask what happened on the the 22nd, do I say thats when mother began restricting my ability to do this? I agree with where you're coming from but at the same time, mother's behavior must be brought to the court's attention at some point. I cant imagine if i dared to do these things it would bode well for me. Again, i have no interest in tearing down mother. I think she should have equal parenting time. Its mother who has the burden of proof to show that radically changing our child's relationship with his father is in his best interests. And I dont think she will meet that burden of proof. She argues that the child needs consistency. I agree 100%. And the child has constantly had access to both parents since he was born and that should continue.

Thanks again. One thing I have to mention. She didn't initiate this process. I did. I live in the home and I dont have any girlfriend or anything, I just couldn't take it anymore.

I agree 100% with you. Thats exactly what I'm doing. And just like you, we happen to be right.
I know it sounds like I'm being weak with a few things but I cant help but believe I gotta pick my battles and keep conflict to a minimum. Hey, this all started last year when in the midst of her being mad at me, demanded I leave the house. I said no. I said I'm not going anywhere. She threatened to call the police. I said go ahead. She actually did it. They came, saw and left as there was nothing to report on. The next day i saw my lawyer. I figured next time she'd punch herself in the eye and then call.
I'm very well schooled in the information you sent and if i knew then what I know now, i wouldn't have ignored the red flags. But I did and here we are. I think i have as good a case as anyone for shared custody and equal parenting time. Im a terrific father and i plan on continuing to be. I will not move out of the house until it's final no matter how much pressure my wife puts on me. She wants nothing more than for me to tire and walk away. Never gonna happen brother. My child is my world and I owe it to him to fight for his right to a father... and his mother for that matter.

Thank you so much! But you'll be happy to know I'm way ahead on that. If anyone wants to lie about something that has gone on in my house, they're going to have a rude awakening.

Yes yes. I've heard that. I dont know. At the same time, if it gets really trivial with her saying "he's nasty to me in front of our child." Or claims she never cursed me out in front of our child. Or if someone asks "did you refuse to allow father to attend a school event and then when father said he was going anyway, did you threaten to bring the child elsewhere to make sure father couldn't attend with child?" I feel like having a tape for that helps. If anything I can transcribe the audio for court. I dont know. If she lies and I bave proof, how can her lies be believed? Or... im overthinking this and no one cares about this petty shit. Thats what I'm hoping. Im hoping its clear that we raise the child together. Shes done somethings more. Ive dont somethings more. We both have spent every day of our childs life with him more or less. We both have the same work schedule. We both will live within 5 miles of his school. We are both intimately involved in all aspects of his life. Period! I don't want to deal with, mother brought him to the doctor 9 times, father brought him 3 times. Father prepared 1000 meals. Mother prepared 435 meals. Father tucked him in 878 times. Mother tucked him in 756 times. Mother signed the scholl registration form. Father signed him up for summer and winter reading programs and on and on.
Do you abuse your kid? Can you take care of your kid? Have you lived with your kid? Good. Can you perform all parenting duties now that you are living alone? Good! Child's time will be split equally between both parents. No child support for either party. Have a nice day.

Yes. I saw a video from one of these YouTube guys about that. The hypocrisy is hilarious. These discussions should be gender neutral. Person A and Person B. They wouldn't know how who to be pissed at. Anyway, the house is gonna be hers because she owned it before marriage but we were dating. 401k sucks because she stopped contributing less than a year after we married and I really ramped mine up after we were married. But whatever. I just want to be a full time father and have a chance to own my own home and go my own way.

I have a claim to the equity in the house. That should offset her claim on my retirement so.
Plus she wants me to pay half her credit card bills. She's not good with money and spends too much. We have no joint accounts. I recently paid off all my debt in preparation for this battle. Let her try to prove its marital debt and not just her wine bill.
