Lawyers on both sides only make money if you remain in conflict. With the filing or protection order litigation has started. This can take years now. The only way it’s gonna go faster as if the two of you reach an agreement outside of court. If you expect the lawyers to finish out and close this case, you may have the wrong expectations. Who is Filing doesn’t matter. It just starts a case. But filing is important. A person who files can request a temporary parenting plan at the same time. If that is approved that becomes the starting point. If no parenting plan is filed, some states enact a default one. Filing also creates legal protections around assets. If your state has common law, you may become classified as “married” even without having a license. So I’m not sure you can always avoid it. In this case, if the mother’s behavior, which you have described as fairly normal and benign, aggravates you, that’s something you can figure out in individual therapy. If she suspects you’re trying to hide assets, all she has to do is get a lawyer, who can motion with the courts and now you’ll be spending your own money searching for your money, and they will be found. Correct, that is the point of CS Let’s say you make $100 and I make $200. If I pay you $50 in CS, we both be expected to spend the same amount on the kids as we both now have those means. Paying CS means you enable the other person to carry some child expenses. Paying my CS is not a get out of jail card to avoid paying child expenses. That’s why most states have a calculator that helps come up with this amount.

Look at the corporate structure. I retained a law firm with many lawyers. In that firm you don’t climb the ranks by silly schemes to increase billing hours. You do it but resolving and winning cases.
