Think about it. 99% of us are going to go our entire lives never being accused of a crime. Even you, as a logical man, are a little bit wary when sitting across the table from another man who's been accused, but acquitted, of a serious crime. Because 99% of normal people go through their entire lives never getting arrested and tried for serious crimes. 8% of Americans have felony convictions.

There's rarely conclusive proof of mens rea, nor will there be until we invent mind reading machines. In the real world, juries draw practical inferences about mens rea based on the facts. Here, they looked at the facts, like the fact he had whiskey dick, that he was behind a fucking dumpster and that he ran when the bicyclists came upon him. Again, I don't know Brock Turner and don't care about him one way or another. All I'm saying is he was a dumbass and got nailed because of it. If he had ta…

I actually haven't been black out drunk before and likely never will. And yes, never sexually assaulted a woman. Like I said, you should try it once. Some of the best sex I've ever had was when me the woman were absolutely stone cold shitfaced.

Absolutely, I'm not trying to argue otherwise. "Don't finger a passed out woman behind a dumpster" is just common sense.

They were both drunk yet he got punished. For all we know he was passed out too and awoken by the cyclists. I'm just stating the legal analysis. As for him being drunk, even if you get drunk, don't be an idiot. Being drunk isn't an excuse to sexually assault someone. Not just legally, but practically. I'm sure you've been blackout drunk before (if not, you should try it, it's fun), but you haven't assaulted a woman. Being drunk doesn't relieve you of your ability to make decisions. It didn't rel…

Was she awake when he started? Doesn't matter. If you're having sex and your partner passes out, you have to stop. No different than them telling you to stop. Was he drunk too? Doesn't matter. Why would he assault someone in public and risk getting caught and having his life ruined? I don't know. He was horny? Again, doesn't matter. And she was spotted leaving the party with him. Doesn't matter. In all of these awful rape posts about Brock Turner that went viral a few years ago, did any of them …

Any of you in high school or college could be the next Brock Turner. He literally assaulted a woman in public. Say what you want about #metoo, the proper steps you need to protect to take to protect yourself against false accusations, etc., etc., the dude fingered a passed out woman in public. If any of you do this, your dumb ass deserves to go to prison and be kicked out of school too. There's nothing wrong with taking a drunk girl home. If you want to protect yourself, record audio on your pho…

In most states the duration of alimony is limited/strongly suggested to be limited to a set percentage of the length of the marriage. That doesn't stop someone from asking of course and there's always a risk you'll get a lunatic judge, but permanent alimony after a 4 day married isn't a practical risk. Edit: So I checked the statute because I was curious. Nevada does not have the limit that some states do, but among the small number of factors courts are required to consider is the length of the…

Meh, there's still a collective action problem. If you can't get women to collectively refuse to Netflix and chill instead of going on dates, you're not going to get them to commit a criminal act. And, honestly, most single guys don't have that much of a value that a woman could take anyway. Is she going to take one of my XL sweaters? A pair of my size 15 shoes? A bottle of booze? Portable speaker? Almost everything would be worthless to them and replacing it would be cheaper than going out to d…

I don't know they do things in the UK, but in the US, a non-executive director isn't even an employee of the company. CEO is a full time position held by an employee. Directors aren't employees of the company. They are responsible for the oversight of the company and meet perhaps a half dozen times per year. There are certainly emails, etc that they need to attend to, but it's nothing like a full time position. Most directors have other full time jobs and often sit on multiple boards. In short, …

Blue pill societal expectation that's a vestige of a time when cultural norms were for people to marry young, have kids and stay with the same person their entire life. You don't need to do that now. Life expectancies are longer and there's lots of single or divorced people in the dating pool. It might seem like you invested time with her, but that implies that you lost something. You didn't - you're more marketable now than you were when you were 20 and will be even more marketable when you're …

Dude, you're 24. No reason to jump on the kid bandwagon now. Heck, you can have kids if you're 60 if you want. You have your entire life ahead of you. If you're making 6 figures now, take advantage of it. Get an apartment with your buddies in a cool part of town. It will still cost you less than living alone and WAY less than it would cost living with her. Bank as much as you can, while having as much fun as you can. If you decide to get married in 6 years (which is still young), you'll have $30…

Remember though, that's $229 million BOX OFFICE against a $144 million budget. It's not like the studio keeps 100% of the box office. The theaters get a cut of that (more internationally). There's a lot of other credits (DVD sales, streaming/cable licensing, merchandising, etc.) and debits (advertising, distribution in foreign markets, etc.) involved and Hollywood accounting is notoriously sketchy and hard to understand, but there's no way that movie was net positive (in real terms, not fake Hol…

That was her claim at trial. She claimed that she knew he had guns because he was showing them to her earlier in the night. She said that later, when they were in bed, he reached under the bed, she thought he was grabbing a gun, so she pulled out her own gun and shot him in self defense. Forensics determined later that he was asleep when shot, with his hands under his head.

Regarding your issues, it's not like people are taking these things into account now. In the US, about 40% of children are born to unwed mothers. Among non-hispanic blacks, that number is almost 70%. Our current system clearly isn't doing much (if anything) to prevent out of wedlock births.

Prenups are rarely invalidated in the US. There are certainly cases where it happens, but divorce lawyers I know say that they are upheld in the vast majority (like 99%) of cases. Most cases settle anyway, so the prenup is just going to give you additional leverage. There are cases where they will be invalidated for "unfairness" (ie, one partner is left with nothing), but any decent lawyer knows how to draft around that. Of course, that doesn't protect you against the judge who decides to invali…

You have to remember other factors as well. While the media just likes to focus on the crime and the amount of time served, judges take more than that into account in determining the sentence (in particular, judges look at whether the offender has a criminal history and whether they are likely to commit a crime again). While retribution and proportionality are certainly elements that go into sentencing, other factors like crime reduction and incarceration costs come into play. And this woman isn…

It's hard to see a bill like that actually passing. As a general matter, we don't convict people of crimes unless they had a "guilty mind" - they had to have acted with intent, recklessness or negligence (and negligence is fairly uncommon in the absence of a dead body). There are some strict liability crimes (statutory rape, selling alcohol to minors, etc.), but they are very rare. That doesn't excuse cornerstore caroline. The rate of false accusation has not been observed to be rising. You're mixing up the words because you don't know what they mean. It's not your fault - the words are intentionally sloppy and misleading - but you should take the time to learn them. You can quote the stats you cite above and say that the person is not likely to be the "victim of a false accusation", but you can't say "falsely accused of rape", because, as ridiculous as it sounds, just because you're falsely accused of rape does n…

Yes, in some places. What I'm failing to understand is why you think pointing out that's how the law works somehow argues against the people here saying the law is unfair and that it should either be changed or that men should plan their lives around it.

Well, that's the argument. Even if you buy that, it doesn't mean that assets have to be split equally in a divorce. Lots of jurisdictions don't view distribution of assets that way. Even in California, Depp could have entered into a prenup that dictated otherwise despite the formation of the "new entity".

Ok, we agree. The worst is pro athletes. I see all these guys get married when they're 22. Your career will probably be over by the time you're 30. Just wait a few years. Not a very good article. Obviously, it depends on the state, but as a general matter cohabitation on a conjugal basis triggers the cancellation of an existing alimony award. The interesting question is what constitutes "cohabitation". People living together is easy. What is hard is when the amount of the award is so high (like in this case - $7,000 a month) that the person has a financial incentive not to move in with the other person, so they enter into a relationship, but keep separate househo…

Just like being sexually assaulted or raped can damage a person's life, but actually ruining the person's life is atypical. It depends on the baseline. There's not much that you could realistically do to Trump that would ruin his life. He has the resources to fight any kind of false accusation, and even if he were impeached, he'd simply go back to his luxury apartment in New York. If you're middle class or lower class? Sentenced to pay 25-day fines? What an interesting construction. It's more common in Europe. In Spain, for example, they assess traffic fines based on your salary. It kind of makes sense. If you're broker, a $75 speeding ticket is a disaster. For a rich person it's nothing.

The idea that child support should increase to infinity based on your earnings is absurd. To be fair, this is mostly a California problem. Most states have guidelines that cap out after a certain income level (which is WAY below $32K per month). California still follows an outdated model despite being a "progressive" (heh) state.

The US campus kangaroo courts start from a position of the accused is guilty, unless they can prove otherwise. That's exactly how far they've gone. No, they use a preponderance of the evidence standard. Obviously the deck is stacked in a number of other ways, but they haven't shifted the burden to the accused.
/r/MensRights18/07/18 04:10 PM
6

Well, that would be an important detail, though I would be surprised if that were the case. Leaving aside the fact it would be clearly constitutionally impermissible in the US in a criminal proceeding, US campus show trials haven't even gone that far.
/r/MensRights18/07/18 03:22 PM

Well, the devil's in the details and the article is inherently inconsistent. If the law acknowledges the possibility of non-verbal consent, I don't see the issue. There's always an issue of proof, but I don't think this changes that. I will say I'm not a fan of changing laws because of one case. Bad facts make bad law.

At the risk of being crass.... has anyone that argues those bullshit "consent games" actually had sex? Of course they understand that it's impracticable. The goal is just to eliminate the objectivity of the legal system - if you make all sex rape, then you can punish anyone you want.

If it is 20+ it is pretty much over for you, in my country at least (USA). That's not entirely true. While it's the case that many states have guidelines that provide that marriages of 20+ years can have perpetual alimony, it's always been the case that the alimony obligation ceases upon the recipient's remarriage/cohabitation or the payor's retirement. Increasingly, there's been a shift away from perpetual awards anyway, as courts have begun to provide for shorter (often reviewable) time period…

I too call BS. Where does a marriage less than 10 years produce alimony and where does alimony persist after another marriage? I hadn't even thought of that, but you're right. The general rule is that alimony stops upon cohabitation or remarriage (whichever happens first). In my state, the maximum length of alimony for a marriage under 10 years is 4 years. You could get 6 (again, as the max) is you were married for exactly 10. But that's 10 years to one person.

I know one girl who had 3 marriages in her 20s, and makes 6 figures off the alimony. She doesn't even have kids, just really good divorce lawyer family friends. Sorry, I'm calling BS on this. The fact you call her a girl indicates she is still relatively young. Even if the prevailing trend was not against long alimony periods, the length of alimony for short marriages (like the kind you would need to be married 3 times in your 20s) is extremely short. Sure she could negotiate for something longe…

The latter. A woman consenting to have sex with a man does not authorize that man to continue having sex with the woman for as long as they want (or vice versa). A person can revoke consent at any time. As a practical matter, it's not particularly common for one person to tell the other to stop once they're actually having sex and I'm not aware of any rape case that's ever been brought on those grounds. That's kind of the point. You kind of did throw the pitch (or hand them the bat, or whatever analogy you want to use). Bars are where single men go to meet single women. Men hitting on you in a bar in a respectful manner isn't "shitty behavior". It's expected and the guys didn't have any way of knowing you didn't want to be hit on. If anything, your presence in the bar suggested the opposite - read any dating sub and one of the top suggestions to women looking to meet men IRL is to go hang out a…

That is not true, because of serial monogamy - some men are able to marry several times, while some never marry. True, but the total years of marriage and number of marriages are equal. For every 40-year old divorced man who remarries a 20-something woman and takes her off the market, there's a 40-year old woman who has become single. Regardless, I don't understand the source of the handwringing. It's not like marriage is a difficult task to accomplish. Only 20% of Americans over 25 have never b…

The number of women who marry men is exactly equal to the number of men who marry women. Similarly, the average (mean) number of sexual partners between men and women is exactly equal. You're right in that women have more access to sex, particularly at a younger age, but you're wrong if you think that's what women want. Talk to any single late 30s woman in a large city. For every 35 year old woman is eventually able to get married, there are many more that are simply never able to find a decent …

/r/MensRights17/04/18 07:35 PM

I'd think that being unconscious should be "obvious" enough. There's really no wiggle room there. It's possible for a person to be unable to agree to sex and for it not to be patently obvious. I don't claim to be an expert, but I thought they were also substantially increasing the value of the standard deduction. Meaning that everyone gets to deduct more in general, and you don't have to itemize mortgage interest, other deductible expenses, including alimony. While I agree with the general sentiment - the change is bad policy and frankly just plain mean - the effect is being overstated. What will likely happen is that alimony amounts will be reduced by states/courts going forward. States set alimony guidance in the 20-40% range with the knowledge that those amounts are tax deductible. There's no particular reason to think the guidelines won't be reduced to reflect the fact it's not deductible going forward. It's not hard - just reduce the amounts by …

Yeah, but that doesn't work with rape. You can't ban someone to not be around women. We don't stop people under indictment for rape from raping by publicizing their names. It's not like that's even realistic. You can't expect people to memorize every name of every rapist published in every newspaper. Even in the internet age where's somewhat more practical (but only if the person's name hits the papers, and only if they give their real name, etc., etc.) people just don't do that. If the person a…

Just like how American supermarket chains are not able to print price labels for supermarkets, if taxes aren't the same everywhere, so that's why it makes perfect sense that in US supermarkets, all prices are without taxes included. I think the most common rationale for this policy isn't because of advertising but rather government transparency. Leaving out the tax lets citizens see how much the government is taking every time they make a purchase. As a result, people tend to react strongly to e…

Depending on your state, assets pre-marriage might be protected even without a prenup. Illinois only lets a spouse claim assets made during the marriage. California is an instant 50% property state. Illinois and California are different in theory (Illinois is an equitable division state, California is a community property state), but essentially the same in practice. In both cases, the spouse isn't going to have a claim to pre-marital assets, even in the absence of a pre-nup and in both states m…

By the time the rest of us got there after worked she was completed wasted. At one point in the night, we were standing in a circle of about 5-6 people talking, with the secretary standing next to me. Really? We must have very different life experiences. Even if you don't count the stupid adolescent crap guys do to each other (like the dreaded sack tap), I don't feel like women just touching or grabbing you in a sexual way is that uncommon. For example, the "1 in 5" studies define "sexual assault" quite broadly, to include things that certainly qualify as "rape"to things that certainly do not. This is a deliberate approach because it allows so-called "victims advocates" to equivocate on terms and, thereby, more argue that there is a rape epidemic, that rape is common, that many men are rapists, etc. This is an important point. People don't just throw out terms like sexually assaulted and "violated sexually" in the context of a disc…

I don't think it was an active measure. I think the lawmakers in the United States are just stupid. Honestly, I think women get these kinds of these mostly because they (in the sense of the feminist movement/legislators) ask for them. If you don't ask, people can't say yes. Look at the current ridiculous push to have the government cover feminine hygiene products. There is not, nor has there ever been, any kind of similar analog with respect to non-female specific products. Toothpaste is just as…

It's another way that the left/feminist movement uses the ambiguity of words to lie with statistics (like conflating sexual assault and rape). When people say that 2-8% of claims are false, what they are really saying is that 2-8% are proven false beyond any doubt (either the accuser has recanted or there is irrefutable proof the alleged r…

What happens if you spent six months in detention, and then are found innocent? Do you get paid for those six months that you were detained for no reason? To be clear, for that reason, defendants are entitled to bail as a matter of right. But still, my point is that I shouldn't have been having sex in those circumstances and I would definitely not pursue sex with a girl who acted like that ever. Really? I've had significant others where that was a pretty common occurrence. We'd do shots, a couple bottles of wine, etc, watch some tv and then hit the bedroom. Or we'd split the better part of a bottle tequila by the pool and do the same. We both fully knew what we were doing and I don't think there was any question as to consent.

Do you think a sober guy fucking a girl who is sloshed and black out drunk, but not literally unconscious should be legal? Or that it actually is legal? The short answer is that it depends. It's legal as long as she understands what is going on and is a willing participant. "Black out drunk" just means she doesn't remember it the next day, which doesn't go to consent. Under the law, you need to literally not know what you were doing. But just out of curiosity, what IS the point of your pre-nup? There are a lot of default legal rules that be changed via pre-nup, even if you have no assets. For example, most states have a calculator for maintenance based on a formula. That isn't the same as the rest are true, since clearly there are cases of rape with insufficient evidence which doesn't tell us whether it is false or true. It's also worth noting that, unless the divorce decree restricts the court's ability to revisit the amount of support paid, courts are permitted to revisit support whenever there has been a substantial and continuing change in circumstances which renders the original amount unfair. A case in which the spouse receiving support obtained a job making substantially more than the spouse paying the support is a pretty easy one as far as making that argument goes.

Most people aren't willing to put in even a modest amount of work. If they choose not to do that, that's on them. I mean sure, that doesn't change the equation for the collective, but the individual only has to worry about themselves and most people can't be bothered to do that.

Women most certainly are NOT willing to be a guy's girlfriend -- not even a sexless, take-your-money girlfriend -- unless the guy meets her standards. Sure. The same is true of men. Getting into and maintaining relationships isn't something guys do easily and effortlessly. I guess we'll just have to agree to disagree on this. Call it anecdotal if you'd like, but I have lots of friends who fit the profile (guys who are constantly having girls trying to lock them down, girls who can't keep guys co…

Women live lives of abundance. The same abundance mentality we strive to develop, or at least fake, women are just born into automatically. This is the primary source of the disconnect between the sexes. Every single time a woman wants to have sex, she can find someone willing to have sex with her. It doesn't matter whether she's in a bar, a club, a coffee shop, or online. With just a little bit of effort and time, even a below-average-looking woman can find at least one man willing to fuck her.…

This sexual marketplace was typified by a reliance on social circle and night time venues to facilitate hookups. Women's choices were constrained necessarily to the men within their immediate proximity. More importantly, these men had to approach her. The last line isn't a true statement and even to the extent it is, it implies it is more a limiter than it is in real life. Even before online dating, any good looking woman would have her choice of guys to take her home from the bar, if she was wi…

It was an audio file (according to the attorney). Probably he recorded sex and then played it to somebody who then told a teacher. But this is speculation. It was apparently a video file, but the video was taken either in the dark or with the phone in a stationary position (like on a nightstand) so there were no images recorded, only audio.

If money is happiness, why do so many rich men kill themselves? Well, the simple answer to your question is mental illness. No one is claiming that having money somehow cures a chemical imbalance.

The only people who think money doesn't buy happiness are those without money and those who don't know how to spend it right.

Have you ever wondered why jocks from your school are usually the most successful people out of your class, even in the professional field? Um...no? The jocks from my high school aren't even close to the most successful people out of my class. Most of the "preps" from my school have been extremely successful - doctors, lawyers, professors, bankers, CEOs, etc. I'd be shocked if any of the "jocks" even made 6 figures. In any case, as other posters are mentioning, it's a common goal in feminist communities to reduce the burden of proof in sex crime cases. It's not even an amorphous "goal". It's being implemented on a wide scale on college campuses by federal decree. Anyone who wants to know what it means for a woman to have the right to be believed need look no further than the kangaroo courts being implemented on their nearest college campus.

I wouldn't be surprised if the rate of people killed who were intentionally run over as opposed to hit by accident would be higher than 10% I'm pretty sure the car hurts just as bad whether the person intended to hit you or not. Obviously speed matters, but that cuts both ways. The person intending to hit someone isn't going to slow down (and might speed up) before hitting them, but a driver trying to hit a specific person generally isn't going to have a long runway to build up speed (unlike the…

In the US, far less than 10% of people struck by vehicles are killed. It's certainly not an insignificant thing, but not every assault with a potentially deadly weapon is attempted murder. For example, you could undoubtedly kill someone by flinging a rock at them (remember David and Goliath?), but we don't charge every protester who flings a rock at police with attempted murder.

If you are a white male, this is a tremendous gift. You'll have women of all ethnicities running after you for the joy of basking in your whiteness. Dude, you're just making excuses. That kind of stuff makes a difference, but it's not that big of a difference. There are studies out there that test womens' preferences for mates. The business analogy here would be that instead of fighting tooth and nail with 500 other guys to hopefully get up the next two rungs of the corporate ladder, where there's 10 spots, I would rather opt out and go my own way. That's fine - you don't have to compete the same way other men are competing, but you still have to compete. If you want to approach this like a businessman, then do (or better yet have a friend do) a SWOT analysis on you. Are you funny? Are you good looking? Do you speak a …

Men will also list their profession and employer, but this frankly doesn't matter as major cities are loaded with high value men who make good money - so women select for looks. I don't think that's true. Maybe in New York, but in any other city, there's simply not that many guys who make a decent living and aren't either (i) committed or (ii) simply spinning plates. The number of those guys who are even average looking is even smaller. If you have a job that evidences prestige and you're not ha…

fairness in competition is necessary to achieve meaningful outcomes Not really - we separate mens and womens sports so that women have the opportunity to participate in sports. If there weren't separate womens teams, there would be no womens soccer/hockey/basketball/whatever players. Honestly, if I were you, I would focus my efforts on other ways of meeting women other than online dating. Online dating should generally just be used as a supplement anyway, but it sounds like you just don't have the physique to fall within the 20% (or fewer) of guys who have a lot of success on these sites. "Ghosting" is pretty rude (to do to any human being) unless you've concluded that no future interactions will benefit you at all. Of course it's rude, that's the whole point. It's a rude act that's done to people who've shown they're not worthy of politeness. I don't advocate ghosting for the random tinder date you hooked up with who is trying to follow up with you, but it's absolutely the right thing to do to a woman who has cheated on you.

Meh. A fool and his money. Tinder's not hard and it makes things materially easier than they used to be. If you're dumb enough to send some women money before you're even matched, let alone having had her go on a date with you, that's on you, not them.

At that point, it's better to just not go out on the date in the first place. I often have dates offer to split the tab or pay entirely, which I almost always refuse. If you're not comfortable picking up the tab, you shouldn't be going to that restaurant in the first place. If a prospective date insists on going to someplace that's more expensive than you're comfortable spending the money on, don't go. Funny how preselection works: women want what other women have, which is why "all the good men are already taken". I think it's less preselection than the fact that women all think they can land a man with an SMV of 7 or higher. They mistake "this guy is willing to date (read:bang) me" with "this guy is willing to marry me". It's not like there's a bunch of single male 8s out there (at least ones who aren't just spinning plates).

Abso-freaking-lutely. The amount of child support is basically fixed - you're paying for the kids regardless. Of the remainder, the woman always accounts for more than 40% of the family expenses.

If you are earning say, 100K per year, after spousal support, child support (1 child) and federal and state taxes, you will probably net about $30K. This is assuming your ex-wife (like mine) quit her job or was woefully underemployed. I don't know dick about California, but this isn't the case in Illinois (a very blue state). In Illinois, the spousal support (alimony) obligation is 30% of gross income - 20% of the spouse's gross income. The child support obligation for 1 kid is 20% of net income…

I think that's a good rule of thumb, but it's a little too harsh when applied across the board. How many guys do you know who look at porn (or heck, even just check out women) and don't tell their SOs about it? Sometimes people legitimately don't think something is wrong, but they want to avoid the fight with their SO. And don't underestimate the power of the hamster. Even if deep down she knows it's wrong, she's probably convinced herself it's ok because reasons.

There's something to be said for buying low. As someone who spent their fair share of time in Langdell Hall, I can assure you there were not hundreds of eligible women hanging around looking for men to date. Any non-law student would have stuck out like a sore thumb. The fact that she told you this is pretty good imo. Most girls would just end up ghosting you. She wants you to improve, and she's voiced her concern to you. Most jurors are dumb and have absolutely no concept how much money $7 million is. Have you ever talked about about money with a ten year old? It doesn't matter if you say $10,000, $10 million or $10 billion. As far as they're concerned, it's more money than they've ever seen in their life. He has the money. She doesn't have money.
