We have a court ordered parent coordinator that deals with these types of matters. She issues “directives”. Ex recently did the same thing and was ordered to give me my days missed back. The PC is a licensed attorney and charges us $300 an hour to settle disputes. It’s maddening. Hang in there.

For the DV case, she defied the DAs subpoena and failed to show up to court. I took a deal with the DA that my lawyer arranged. My non-tech ex thought removing ring cloud cameras while I was in jail was a good idea. She tried to destroy evidence and then took the kids to her parents. Your story is similar to mine. Older teenagers 60/40 custody. I took less time and she took less CS to keep things from going to a full blown custody trial. I worry she will try to take me back to court for more CS at some point. If you have everything documented and journaled you should be fine. Trust me I get it. I did the same thing. Tracked the payments, zestimate, equity from the date she abandoned the home to the day it was sold. I thought surely I’d get reimbursed. You should keep track of the payments. I doubt it will have any impact on how the equity is split if you sell or buy her out. At least it didn’t for me. I paid the mortgage for 11 months following the separation and wasn’t reimbursed when equity was divided. I live in an equitable distribution state.

Some states you can file an alienation of affection claim against AP for financial damages. Hawaii, Mississippi, New Mexico, North Carolina, South Dakota, and Utah. My ex did the exact same thing. She lied on her counterclaims, interrogatories, discovery and on the stand during one of our brief motion hearings. Not me but a close friend has a child on the spectrum. They are handling it pretty well considering the circumstances. No ethical lawyer would give her guidance to keep the kid from you. If there are reasons thats a different story. (DV, child abuse,etc.). Based on your comments I don’t think that’s the case. Sounds like she’s being vindictive and likes the cash payments each month. I’ve said this before, but using children as pawns looks horribly in front of the judge.

I still have these moments as well. Separated 2 years ago. Divorced 14 months ago. The only thing that gets me through it is thinking about her betrayal. In some jurisdictions texts and emails cannot be used in court. I recommend using OFW even if you have to pay for 2 accounts. Our court order states we should only text when it’s an emergency about the kids.

Stay away from her. I would go no contact if possible. If she can prove DV that opens up all kinds of possibilities for her attorney. Marital misconduct can be used against you and if you have kids the custody case could become an absolute nightmare if she claims DV in front of the kids.

In NC you have to go to a court ordered mediation class and then have a court mediation session before they will even allow you to set a custody trial date. The class is meant to scare you into mediating. And you can be held in contempt if you miss the court mediation session. Of course my ex wouldn’t agree to anything and we ended up in private mediation multiple times before we settled.

Filing frivolous motions and over litigating can backfire. Judges don’t like it especially if the couple has money. From my experience a majority of the people in family court are either under represented or representing themselves. Every motion or complaint that I filed always had my signature. Signed in person at my attorneys office. I just got billed for 12 minutes last month. We had one conversation about free baseball tickets that the firm has. The system is f’d.

You need to file a custody claim with the courts asap. This will likely force her to negotiate with you on a temporary custody and child support consent order. Do not wait. My initial custody claim was 2-3 pages and was completed in a few hours by my attorney. We filed it with the court the same day. EDIT: My ex wife pulled the same BS.
