Actually interesting point. I like your impersonating the husband question, because it does seem to imply that there is a point at which you're lying enough to break the law. Should this crime be rape, or impersonation / identity theft? Also going to the other end of the spectrum: What if a guys says he is an astronaut? What if he claims to be a different religion than he is? What if he put on his dating profile that he makes $120K when he only makes $80K. At what point does that make the jump t…

So maybe it's just me but I still don't like this: "Coerced or misguided, obtained willingly or through deceit. Consent is an act of reason, accompanied by deliberation, the mind weighing, as in a balance, the good and evil on each side. There is a clear distinction between rape and consensual sex and in a case like this, the court must very carefully examine whether the accused had actually wanted to marry the victim, or had mala fide motives, and had made a false promise to this effect only to…

I've been running anti-game for years, but it's not like that. Anti-game is the type of game that makes girls feel stupid for running their games. It is devastatingly effective. All of sudden they start realize that all they're doing in playing games, then they love you for not putting up with it. It is sort of like turning all of their game into one giant shit test and beating it all at once.

http://www.dailyprincetonian.com/2013/05/06/33521/ Scroll down to the bottom. This is my favorite paragraph (emphasis mine): "The majority argues that the COD’s discretion in doling out punishment would alleviate my concerns that innocents could be unjustly charged and punished. This would imply that if there were only a preponderance of evidence, the COD could mitigate the punishment accordingly so that if the accused were actually innocent, he would be punished less severely. This misguidedly …

Actually not even most feminists believe R3 is rape. If genuine consent is given by both parties at the time, I think everyone agrees that is not rape. The real problem is that you have a world of nuance between R3 and R2. There is one telling thing you include in your definition: The perpetrator must genuinely believe there was consent at the time. Really what you're trying to add here is the legal concept of "mens rea" meaning knowledge of wrongdoing. I think it's an interesting debate whether…

Technically there are many situations in which two people can rape each other. Two mentally handicapped people have sex. Neither can legally consent --> rape. Two people on ecstasy have sex, both are under mind altering substances and cannot legally consent --> rape.

But in all honesty, alcohol can cause a rape. If two people consented but they were both drunk then the alcohol actually caused the rape. Not either of the two parties.

Miranda rights, sentences 3 and 4: You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. If you cannot afford an attorney, one will be appointed for you before any questioning, if you wish. Also yes you can trust the lawyer appointed. Impersonating a lawyer is a crime, breaking lawyer client privileged will get you disbarred.

Not sure how you could possibly form an opinion from a blog post lacking facts and written by a friend of the alleged rape victim. If the girl was in fact raped then this is a perversion of justice. She should go to the police and ask for an investigation. If she refuses to do that then she should acknowledge she is not allowed to claim this man raped her. I think that's fair. I understand a rape victim may not want to go to the police, but if he/she don't want to go to the police then they can'…

There is no "answer" to your question. Everything we try to do to think about it will be colored by our own biases. The best way if we really wanted to answer the question is to find people who have been both raped and falsely accused of rape and ask them. Really though the important idea is that you should say I don't know which is worse, but they're both bad and we should be equally invested in stopping rape and stopping false accusations. Period, full stop. You don't have to determine which i…

Well you can technically buy that from a prostitute; it's called the girlfriend experience. But again I refer to my first post - regardless of your specific needs you don't have the right to anyone's time, connection, or love. You have to earn it. MRA's and others can provide you support and companionship as you go about your journey to earn those things but it is still not your right.

No one has a right to a relationship with another person, therefore this is not about Men's Rights. Both men and women have the right to deny relationships or sexual contact for any reason they choose. That said I think MRA's are generally in favor of legalized prostitution which could solve this problem.

Well okay her facts: Unrelated to any true argument: Rape is stigmatizing for the victim A "small" percentage of reported rapes end in a conviction Rape victims are aggressively questioned as part of the trial process Women who make false accusations or otherwise recant testimony can be charged with a crime These are all true facts but don't seem to support the conclusion. Here's my response to your argument. Feminism is not responsible for many of the social problems men face. However Feminism is responsible for many of the legal programs men face. I couldn't tell, was this meant to be a simple solution or a debate tactic used for discussion. Either way this is more complicated than the simple: every child should be given a paternity test at birth for the good of the child. It has a right to know who it's father is for medical reasons.

You did not fix it, "Communicated to her partner at the time" legally doesn't matter. "Felt at the time" can matter. If she was threatened she could have said "yes" and in fact legally and morally she has not consented. This is important otherwise you could pull a gun and say if you don't consent I'll shoot. That doesn't and shouldn't absolve you of rape. That is the message that Vicky is trying but mangling with the last sentence of her quote. And her conclusion that it makes false accusations …

Okay, if you look through my comment history you'll see I've gone through this with my girlfriend as well. My most important thoughts, some of which may be late: 1) Don't identify as an MRA - in all honesty some MRA's actually do hate women, unfortunately we have a tendency to be defined by our worst members rather than by our best and most eloquent. (Before I get hate, I'm not saying you shouldn't be proud of being an MRA, just that it's a bad way to go about convincing your gf). 2) Check your …

I think we should be open and welcoming to people who self identify as feminists, because they can make powerful and dedicated allies. to reduce the misunderstandings some people walk away with, but in all truth, those people will take away whatever is they want to take away. There are some people who don't come here with an incoming idea to be taken away. It is for those people that we do our best not to generalize and to be inclusive.

Maybe it's just that I live in a young, liberal, single, Ivy educated bubbble, but I feel like the majority of my female freinds identify as feminists, but they would have espoused the same feelings and emotions that mmmmm said. Feminist groups channel a lot of money to worthy charities that do work to equalize education in places where men are provided an education but women are not, such as Afghanistan. I agree there are places in the developing world where men also have problems, but there are some places where one of those problems is not access to education. I'm not sure why you're fighting this so vehemently.

I know I'm going to get down voted to hell but feminism is doing positive things in the name of equality in places where women are truly oppressed, like fighting for and achieving more equal education rights in the developing world.

Yes many secular Jewish girls in the U.S. describe themselves as feminists because they contrast their beliefs to Orthodox Judaism which many westernized cultures would consider pretty oppressive to women. However, when you talk to them, they're not really that feminist at all. Jewish MRA here. I don't get it either, circumcision is fine by me. Parents make lots of choices for their children. Don't let the fact that you don't agree with every plank in the MRA platform make you feel like you can't be "a true" advocate. Two things I'll say. A. It shows that only 8% of rapes are reported. That's a high estimate by most measures. B. This makes me so much madder than most of the stuff we post here. It's this abuse of men by the government that makes me so upset. All the social stigmas and societal issues are secondary to the fear of being taken advantage of by my own government.

Start with countering individual feminists claims without advocating for men's rights and insulting feminist. I've always said the wage gap is the best point to bring up to feminists. It's really not as emotionally charged as rape, custody, divorce, etc. And there are a wealth of studies. I've always done very well in talking even to feminists by saying "I totally agree that the wage gap is an issue, but I define it differently, and when you take into account choices it's only 6% rather than 25%…

I agree most people think that, but the laws are written in a way that they are not enforced that way. Remember men's rights is not about men's relationship with women. It's about men's relationship with the Law. Focus on the government problems first, then we'll get to the social problems, that's what feminism did and it was the right strategy. They didn't try to make having sex drunk socially taboo, they made it illegal now they're trying to make it taboo.

I like child support with divorce, that makes sense and it obviates the need for alimony in many cases. I don't like the need for child support outside of marriage, but that will end up with the state paying for more things for these irresponsible mothers. Do we then just all pick up the tab?

Point blank: They will not exist from an unbiased source. I'd focus on a completely unbiased source like this one then say odds of a... Male being raped by a stranger: 0.010% (151 MM / 14 K) Female being raped by a stranger: 0.014% (156 MM / 20 K) Within the margin of error of the survey of being identical. Tell her to fear her friends but she's about as likely to get raped by a random dude on the street as you are.

Here's the thing, I believe this is systemic, that many people are taken advantage of by the restraining order system in place. It is a valid issue. I furthermore think that the majority of victims are men. Therefore I believe that everyone who believes in justice should stand up against this. However especially men should because they are most likely to be the victim of restraining orders being used improperly. Look if you say that this can't be a men's rights issue then what would you define a…

I don't understand your position that this is a psychotic human issue. Why can't it be a psychotic human issue in this case but in general indicative of a broader men's rights issue. A woman being raped is a criminal issue but rape in general is a women's rights issue. For these reasons, I maintain that if someone can act/lie/dramatize their situation well enough, and to a high enough degree, the same result would be produced regardless of gender. I'm going to continue my rape parallel here. All…

Okay so we agree that restraining orders need to be tightened up, shouldn't be given out as easily and violations should require evidence to back them up. Good that makes sense so I'm glad we are in agreement. However, I still lack your conviction that this is not a men's rights issues. If a law is disproportionately affecting men why shouldn't it be a men's rights issue. IANAL, but I guess marriage vows could be construed as a verbal contract. The ring itself could also be construed that way in a particularly acrid divorce. Seems like you should be willing to do this to put his mind at ease.

I've often thought of this. If you live in a state without common law marriages and live together but don't get a marriage contract are you married? Is there a point at which the law would claim you are married? Could your SO file for divorce? Why don't more people do this?

I would recommend making the entire discussion about the causes. Let them come to their own conclusions, if you start with "the wage gap is false here's why" you'll be immediately rejected. If you start with "let's dissect the wage gap" you may have more open minds to debate with.

Just remember that during this discussion you will become the mouthpiece for all MRAs. I would strongly urge you to make your discussion about the causes of the gender gap! When you say that it doesn't exist you open yourself to logical and founded retorts (it does in fact exist, women do get paid less than men). Say instead that you want to examine the causes of the wage gap and then show how many of the causes of the wage gap cannot be "solved" and are not based on discrimination. Three links …

In all honesty though you should never send avoiceformen to people who aren't yet understanding that there is a problem. It is not a good website for convincing people that the problem exists, it covers too many issues and often times assumes you understand its perspectives (that is what I've found anyway). Actually there is. BLS studies say that of the 22% wage gap ~5% is unexplained by data. That means that about 1/4 (25%) is explained by bias or non-cash compensation (benefits, insurance, etc). You're right that this is within the margin of error, but still he's not totally off.

This is amazing. How the hell do they have the gall to claim: Being made to penetrate is a form of sexual victimization distinct from rape that is particularly unique to males and, to our knowledge, has not been explicitly measured in previous national studies. +1 Try to have a class on male rape. How men can avoid it, how to identify it, how to report it when they feel they've been raped and what resources are available to them. How to talk about it with other males or females to avoid being mocked. Also, in our fraternity we had a police officer come and talk to us about what could be construed as rape in the eyes of the law. I like your style one additional point. You don't mention the wealth that each brought into the relationship. This should be returned to the original party. I agree wealth accumulated within the marriage should be split roughly 50-50. There needs to some adjustment, let's take our standard family. Dad has worked and accumulated money, wife has spent time tending to house and raising child. For her time and investment with the child she is rewarded with custody. Yes this is exactly correct. Law before Lily Ledbetter: You have X years to file a discrimination case from the day of your first discrimination. Law after Lily Ledbetter: You have X years to file a discrimination case from the day of your last discrimination. The law is actually pretty sensible. No he's implying there are far more single parent families. Where a women is the only and therefore primary breadwinner. Alternatively if the woman is a lawyer and the husband works construction there can still be a pay gap (the wife is paid less than fellow lawyers) but the female is still the primary breadwinner. Look I don't believe in the wage gap either, but it's incredibly possible that both the wage gap does exist and that women are increasingly becoming the breadwinners.

Hey jerk, there's a huge level of ambiguity between the obviously wrong "see them drink a bottle of vodka, falling-over" drunk and the "I had two drinks at dinner and now I'm sleepy and just want to go to bed" level drunk. Your discussion at the extreme end of reality is neither productive nor informative. Also that "should have been aware" is tough to apply in court because most often both parties have been drinking. I appreciate that the responses are highly logical and I agree with them. The true problem comes not in how people think but in how the laws are written. And many feminists believe these laws should be in place as is as a shield. They understand what rape is quite well and define it accurately in their own lives. But they don't support changing the laws to have the legal definition more in line with their own thoughts. That's the problem.

Interesting, however that's only in Australian case law. In the U.S. it's quite different. You're right, I didn't want to write out the myriad reasons no-fault divorce is destructive but you have named two big ones. But your point about fathers means we as a society would be better if more children were raised with a father. Therefore we as a society should encourage that.
