I appreciate all that man. Get ahold of me if you want some advice or some motivation to move forward. With our similar situations, I could tell you how it’s all gone and gotten worse as time went on. I just don’t want to see you put more years into this thinking it’s better for the child or that it will eventually change. Like I said, she fooled me a couple times. Well pretty much all of our debt is in my name. I know it’s all marital property and it will get split, but if I owe her 60k to keep the house (yes it’s half of the difference between what is owed and appraised value) and she splits her half of the debt with me, they would essentially take that out of the 60k I’m pretty sure. So instead of owing her 60k for the house, ide owe her 25k, but still have the full amount of all debts to pay for. Which is roughly 2000 a month in payments. Ide only be b…

No unfortunately we are both very involved in budgeting. I did add up finances. Basically if I took her share of the debts off what I would owe her to keep the house, I would owe her roughly 25k. Ide keep the house, but still have all the debt and payments to deal with. That would be roughly 3k a month in debt. I guess I don’t know what to do at this point.

My pension, 401k, and stocks are protected under a nuptial she signed awhile ago. My problem with setting up another account is, she’s going to see that not all of my paycheck is making it into our account like normal, and then she would take action. Honestly that tool value number won’t ever be accurate. Who’s to say what I have hasn’t mostly been bought pre marriage, or any receipts she could dig up, who’s to say I didn’t sell/ trade down the road. I think that would just have to be a number she thinks is fair. Which she won’t really know anyway I’m sure.

It’s funny you say that, a few years ago she had seizures, which led to a brain scan, which led to the finding of brain leasons. Doctors figured it was the start of MS, but after a year of monitoring, they took her off of any medications stating that it’s stagnant

Ide be willing to bet your attorney could write it up the same way. The hardest part was bringing it up to her. I waited until we had the “where do we go from here” conversation and kind of ended it with that idea. She wasn’t mad or anything. She just agreed and I handled the rest with both attorneys

We had separate attorneys. Hers was a small town divorce attorney, mine was a little bit bigger. But he basically wrote it stating along the lines of “ we firmly believe that in order to save this marriage and let it prosper, both parties agree to a postnuptial contract, so that the stress and worry of retirement garnishment, if this were to happen again, wouldn’t hurt the marriage anymore”. I pretty much just said I want to work on this with you but on one condition. Basically my lawyer wrote it up saying that neither one of us could touch each others pension, stocks, 401k. She doesn’t have any of those things, but he included us both to make it sound better to her. We signed it and now it’s a thing. He said sometimes post nups are tricky because it could possibly be fought in court, but apparently in my case, it’s pretty solid.

When we went through it last time, we signed for 50/50. I know I can get that. As far as keeping the kids away from whatever she does the other 50% of the time, I don’t get to do that anymore and it’s scary. So after the first almost divorce, she somehow agreed to sign a post nup, protecting my retirement, but that’s about it. Not that I have any assets other than the house and car, but everything else is fair game. I know if I do this now, I can at least avoid alimony since we haven’t been married long enough, but the child supports is still a shit deal. That’s all she did right before and during the divorce is live the “single” life. Now it’s happening again. When we went through this the first time, my lawyer said there was nothing we could do to change custody any more than 50:50 until she does something really dangerous

The worst part about that is she portrays herself in front of other people that she’s a great mom, she’s perfect. She does everything and I’m just some bum that doesn’t deserve the kids. I definitely can’t rule that out, but every time I investigate her whereabouts or what she did, it checks out, she just doesn’t tell me anything.
