No, I should have worded it better. We have the traditional 50/50 custody, but I watch our 3 yo during the day, even during her weeks. Also, the oldest son gets off the bus at my house and I have him for 3 hours before taking them both to her house on her weeks. I wanted to word it more to say I see them both far more than she does, even with 50/50 custody.

Thanks for the responses. They give me some hope I can stop this from happening. I imagine I’m like most, with my life being a bit rocky because of my exes decisions over the last few years, so I’m just wanting some consistency.

Thanks for the responses. Ideally, staying closer would be best, I’m only looking because the cost of the current city has gotten to be a bit much for my situation. I work remotely, so the country seemed like a good option depending on the drive for the children.

Thank you so much. That helps clear up a misunderstanding I had of the process. As to answer your question, I haven’t had it appraised yet, but the exact same floor plan in my neighborhood (better yard, but not as good of a view) just sold for $120,000 more than my original mortgage. So, I feel I would be able to but her out without the equity portion being in question.

So much of your situation feels like I’m reading my own story. Honestly, I don’t know where I stand. Her and I had a verbal agreement as to what we wanted to do and had that idea going on for two weeks (her lawyer wasn’t kept in the loop by her) then come the day before mediation, she flipped her mind. It’s sounds like we were in the Med/Arb phase then (we did no mediation prior) but the mediator was a lawyer in our situation. My STBXW’s lawyer messed the whole thing up, he agreed to pay for the mediation cost in the agreement that we would try for a second mediation. Oh, I guess my wording was off. But I have both boys, but your statement still stands. I do love the idea of no other “men” trying to influence my son, I just worry how he will be affected down the road knowing his mother wanted his older brother, but not him. Maybe I think into it too much, but it bugs me.

Her reasoning is our 8 y.o. is easier and causes her less stress overall. My original plan, when I found out she cheated, was to go for primary custody for both, but I’m nervous of battling her in court because I don’t want anything less than 50/50 and I have no idea what she would come at me with in they scenario.

I’ll definitely take a look into it. I feel good on the looks, it’s the height that gets me. And I can’t say for sure from what you are writing, but you feel like you’ve taken the red pill to me and I’m just here to say, I have as well after this situation. Everything has changed. You hit the nail on the head as far as the stable aspect, I ain’t going to own up to the second half of that’s statement though lol. I was just talking about doing a DNA test on my youngest. The oldest isn’t biologically mine, but was hers from another relationship. I actually adopted him last year believing we would be a family (I would shake my own head, but I do love him and he as no one else.)

Oh, I filed for a divorce and primary custody back in August. She didn’t get a lawyer until early November just right before a summary judgment could be declared sadly. I’m willing to do 50/50 and thought we were going to, but then she tried to hit me hard with her lawyer and provided quite a few lies in the process. If she can’t agree to talk, it’s looking like mediation next.
