I know the court order is extremely long, but it should all be spelled out in the court order. At least it was for me. Seemed like bolier plate standard language used in most divorces in texas. This is in regards to pickup/drop-off times and the schedules and deadlines. The only custom language we had in there was regarding the location, other than that it was standard stuff for parents that can't come to their own agreement. I warned my ex about this but she wanted to let the judge to decide.

I don't think this is really enforced strictly. Pretty sure my ex didn't complete the class. Not that I needed classes on how to raise my kids, but there were some very specific things regarding texas and additional resources. Each county I'm sure is a little different. I'm a little surprised your lawyer didn't mention this to you. It was part of my opening packet of shit to do.

If it is a school holiday on a Friday or Monday you get that time. Pick up times are usually as soon as school is out. Every situation is a little different what exactly are you asking for? Summer, the non custodial parent has until April 1st to notify the other parent of summer plans. Custodial parent has until April 15th to take a weekend from the non custodial. If nothing is said non custodial parent gets the month of July and 1st, 3rd, 5th weekends in June starting at 6pm, returning 6pm on S…

I believe you can get that dismissed. Because you are the primary and daughter lives in SC, SC has jurisdiction over your daughter.

In texas it doesn't matter how much money the primary parent makes. For child support they only base it on the non custodial parent. 20% for the first child and 5% each additional child basically. For support calculations I believe they cap it at around 9k earnings per month. So if you make 20k a month the calculation is still based on 9k.

I got primary on both. What fucked my ex over is she thought she was punishing me by abandoning her duties as a mother. She found out the hard way on why you never ever leave the residence especially with kids involved. I had a sister in law that did the same thing and she only left for 2 nights. I don't know about other states but in texas do not move out.

10k over 14 months might be your problem. You might have gone too cheap. Personally I would immediately file for false representation from your lawyer, and get your money back. You can get a delay in court because of this problem but if your fighting for 50/50 now is the time to get a better lawyer. Also how not could you realize the first guy was the husband cpa?

Sounds like a standard crappy deal. This is basically every other weekend. Can't get a little better? How old are the kids?

That's on you. Every parent, including dads, must know of the details about your kid and his/her progress. If you wait for someone to tell you, it's already too late. If I pay the first semester for an adult kid to go to college and they don't want to show me their grades...cool next semester is on you. Who gives a shit what the court says.
/r/Divorce_Men25/03/23 06:52 PM

I can't stress how important it is to take care of all the kids' activities. If you expect 50/50 when you're done and divorced, who is going to take the kids to school on your time?

All of the points you make are completely meaningless. She's going to take as much as she possibly can, request you pay for her lawyer and request primary custody so you are the one paying child support. Not the time to diy a divorce.

This is the very reason why I did not put on travel restrictions in the USA. We are not allowed to bring them out of the country but can go anywhere in the USA. I'm amazed at some of the details put in these custody agreements. I would take her to court and get that language removed. You would have to get permission to go to the grand canyon? F that. Just a notice is all that is needed.

In my experience, if they do the wellness check once they will do it over and over. I'm up to 5 or 6 times now. I've been home for all of them except 1. I was at the ER with my middle and left the older (12) with the younger 6. This will hopefully be addressed when I go to court later this year but for now, it is what it is.

I would never do anything with my ex but we ended on bad terms. That being said I'd just say once we can get this divorce finalized amicably then sure. Until then no.

Why not do a separation? Plenty of older married people out there living separately because it is too expensive to divorce. If you have access to the assets move half into your own account. Or the 1/3rd if that's all you want. Seems you have enough assets if you all went down the lawyer route you will both be broke. Any income you both earn just split it 50/50 going forward.

You haven't filed yet. The judge isn't going to give a shit what your wife spends things on prior to filing. Juge won't give a shit post filing either unless she uses marital assets to drain both of your money.

I'm from the USA. But if it's the mothers intention to move out of the country with the kid, no way that would work here. Unfortunately our justice system has made some grave mistakes and has allowed kids to leave the country with ex spouses with ill intent.

Depending on the area you live you could be majorly fucked. My sister bought a house pre-covid for 350. It's worth atleast 700. My brother is in the same boat with his house. House across the street from him sold for 400k pre-covid. They sold at the peak of the housing frenzy for almost a mill. Edit to say that if you've been married only 4 or 5 years she got to enjoy that ride up with you and she's ready to cash out. There is a reason why she is being not so forthcoming with this other lawyer. …

I kept my Facebook account. Just deleted her and her family. Never had many friends on fb anyway. Maybe 50 or so. I only use Facebook for the marketplace and some groups I'm a member of. If it wasn't for marketplace I'd probably delete the app.

I think it's equally as important to select the right county to file in. Some counties are more liberal and others are more conservative.

I'd have moved to said location 7 months ago when she moved out. Now your both wanting to leave the state and you have started the divorce process already. You are running the risk of the ex getting the kids because she is already established in her new state. I would rethink your plan but let us know how it goes.

Don't tell her and don't bring the girlfriend when you pick him up. Leave her at the hotel. Than bring the girl along back for the drop off.

I don't know where you live but courts don't like kids moving at all when the divorce is not finalized. It creates a jurisdiction issue especially if you move to a different state. I would focus on getting the divorce finalized...than you can move anywhere you want especially if she is already states away.

Well you already have a GAL involved. Your wife does not get free lawyers for a divorce. If she does you are going to be tied up in the cps/dcf system for a while. Your already 75% of the way there with a GAL. I'd hit the gym and 100% go on the offensive. Divorce court is hard enough on men. You ain't seen nothing until the child courts get involved.

Your all over the place emotionally. According to your text just yesterday you agreed on separation and you went and saw the inlaws where you stood your ground. I guess if you want advice get yourself in order. That doesn't happen after 1 day.

For an uncontested divorce I'd be shocked if a lawyer cost more than 3 grand. I'd bet most of them charge 1500. There just paper pushers at this point. Contested divorce now....that's the bread and butter. Get a real lawyer if you actually have that kind of money.

I guess I'm a little surprised that you have to show any bank accounts. I'd write it up as you keep your accounts she keeps hers and I'm gonna write a check for 45k to her. I think you all are going to need an agreement on the child support as well. Typically judges like to do things via the state guidelines but some states are forced to honor an agreement between the 2 parties. Why would a judge want to look through your bank records? It's the lawyers that want all of that if it's a contested d…

I don't see why she would agree to that. Turn the tables around. Would you rather get 120k (taxed) over 3 years or 100k now. I know which option I'd pick.

Why would you pay her 40k for 3 years in exchange for a 1 time 50k payment? Putting her on a w2 wouldn't the company have to offer benefits? Your idea seems way too complicated.

Did your ex move to a different state than the one you claim residency in or whatever your driver's license is? There could be a jurisdiction issue because she can't move to a different state without the kids and have that state make custody decisions. If that is the case I would highly suggest to file in the state where you and the kids claim residency. That will really put her on the defensive when her case gets thrown out where it currently is.

I lived in an RV for a year with my ex and kids. Take pictures of the activities you do with the kids, things your teaching them. Hopefully you are already doing home schooling. Places they have gone. She is the one that abandoned you and the kids your making their life great.

You are still raw and in her frame. I just moved all my photos to an external drive and yea happy I have them. Love looking through old photos with the kids. I don't care that the ex is in some of them. Your behavior is that of a teenager.

My ex cheated on me. I stayed with her for another 4 years. It is next to impossible to rebuild the trust. Plus if she is not meeting your sexual needs prior to this it will never work. She will love bomb and all will be fine for a few months. You may even get her to sign a postnup. The same shitty human being will return in a few months.

I was in kind of the same boat. Ex didn't do shit at home and when she got a job it was a restaurant job. Working weekends and late nights...slip on a dick well we know how that went. I'd be very weary about a job she gets that doesn't align to your schedule. Especially low paying crap jobs.

It's 50/50. My ex took me to court over that issue and others but that was ordered 50/50 by the judge.

I was in the same boat. I wanted to file married because we would both get more money back but she lied about her earnings and I was able to prove it so on the end I filled HOH. I was able to keep all of my return money because she didn't file and ended up getting more rather than splitting 50/50.

Asking 30k for a marriage lolol. Isn't the wife/her parents responsibility to flip that bill for their little princess? She's using you for money.

It depends on the state. If your in Texas someone is gonna be on the hook for 30% regardless if it is 50/50. Other states look at the income of both parents.

So I home schooled my kids and basically became the no fun police. That really helped me get primary custody. I don't know how old your daughter is but if she is under 12 I don't think they should have any input on their living arrangement. My daughter claims she wants to live at her Aunts...well probably because she lives in a house full of boys and her aunt has daughters.

Gotta turn up that DNGAF meter. You mention that you asked this dude about holding a baby by the crotch at a trade off that ensued to felony DV charges. At my drop offs I observe and document. Have a recorder on you. But to always have something to say is just ridiculous. I don't say anything. All communication goes through an app. If she starts talking I just say let me know in the family app.

Get a recorder. Took my ex month and a half to hit me. Turn up that DNGAF meter. She is trying to provoke you into violence. Cops were gonna take me to jail for dv, but thankfully I had the recorder and they gave her a ticket. Should have taken her ass to jail but whatever.

I mean if your lawyer says get a psych evaluation what do you expect random strangers to say? Not enough context. Sounds like you created on hell of a monster in the prior relationship.

If she is paying you child support you should be able to get life insurance on her. I'm thinking about doing the same. You don't need her signature just a court order stating you are to receive cs. As far as estate planning for your death. Well that's what lawyers are for. It's really not that expensive. I'm more concerned about taxes rather my exes mismanagement. I guess I'm confused why she has to tell you it's "OK" to pick up the kids. You have every right to pick up your kids whenever you want. Until a custody arrangement is figured out they are your responsibility 100% of the time. The day I decided I was done with my ex, I took over 100% of the parenting decisions.
