Personally, I would respond, I will agree to that if they are able to celebrate Christmas with me this year. I would get a lawyer to file an emergency hearing. I didn't offer to change child support if she agreed to 50.50. But a few months later I got laid off so I had a legal material change. My lawyer used that and the fact we're doing 50.50 to terminate child support. Mom couldn't go back on 50.50 because the child was already got used to the new arrangement and wouldn't be beneficial to change that back.

Unpopular opinion, but I think most groups are labeled negatively. For example, anytime I hear someone is a feminist, I run for the hills. I agree though women have a lot more leeway than man. However, I admit, when I say I advocate for fathers in family law context, it doesn't get much hate.

I doubt it. The wedding is called off and the mother should be perseuing the biological father, who would also have rights to see their kid. If this happened when the kid was 5 or 6 then it might be different but the kid is just turning 1. I wouldn't be surprised if she does do that as a way to ruin this man's life and haunt him for life. You give an inch, she will take a mile. Don't give her anything and impute full time income to her. She should be working full time now that she's on her own. With 50.50 custody, the child support will be based on an offset formula. It should be significantly less than what you would pay if she had full custody.

I would just say you're seperated and not talk about the legal/court stuff. I would agree with other that you should file. No point in procrastinating if the end of the road has been reached. Best if you can compromise an agreement with her and get it done and over with as quickly as possible without involving lawyers and the courts. The sooner you solve this, the sooner you can move on!

I've thought about this. It should work in theory but in practice with my ex it would go like this: Scenario 1: Mom arrives with child. Gets out of car with child. Hugs and kisses child for 6 hours. Just talk to your lawyer. Ask to meet with him. Tel him you want to know where you stand, what the strategy is, and when you could expect to have more time with your kid. I can see why they would want to do it where the relationship is abusive, and it may make sense. But I think there should always be attempts to address the relationship, counseling or whatever it may be. Even if it's supervised visitations until the relationship is addressed.

Unfortunately, and as much as I hated being told this, she can do whatever she wants with child support. It's stupid I know. It makes no sense. They should have to provide reciepts they spent the money on the child. Nonetheless she's paying for it on her own now so it's all good. Well not all good because I paid for most of it. Do you want to be in the child's life? Do you want to see the child? Can you maybe move close to her if the child is yours ? How will you plan to confirm if the child is yours or not ? Are you communicating with her? The situation you have mentioned with the child being yours and you being put on child support is the worst case scenario. If it turns out to be yours and you move closer to her and share the child 50/50 it will be based on the difference of your incomes.

I think the important thing here the courts looks at is the fact that you are both living in the same household. That means the status quo is 50/50.
