Update: I know have a Final Judgment Against her employer the garnishee (a big plastic surgery clinic) they failed to respond or show cause to the wage withholding and the Conditional judgement. I'm placing a lein on the clinics property at the probate office and already served discovery to find out which bank they use. I also plan on filing a Writ of Execution so the sheriff can take some of their property or do a stand by at the front desk to collect the amount owed.. They have about 2 weeks l…

I appreciate that. It was a long battle and while we managed to get a better deal in trial then we hoped. It doesn't feel like a "win". I spent over 20k in lawyer fees. She trashed the car before handing it over and now claims the title was in the glove box. It wasn't. And Its a whole different process to try and collect on the judgement now, so who knows if I'll even see that money. It has hard to see her in such a sad state and her new boyfriend is 15 years older, overweight and looks just as …

I was pro se for 6 months, did everything from discovery, motion to compel, sanctions, etc. My unanswered discovery basically won the case. I had 76 RFA discovery questions deemed admitted as facts on the record and my sanctions for interrogatories we're also approved. My main reason for getting a lawyer was for trial only. And shes charged me $12,000 in 5 weeks of work including the trial last week.

I understand your point. Its just the amount awarded to me vs what I owe this lawyer is basically a wash. All for nothing and everyone losses except the attorneys. I was pro se for 6 mo the and basically won my case with 4 different discovery requests that went unanswered, even after I filed a Motion to compel and a motion for Sanctions.

The prevailing party typically drafts the final judgment. We went to trial and got a bettwr outcome then out settlement offer.

Defending 2 PFA's, criminal charges and divorce....yeah it cost me. We also had a house, but I got that sold with a motion to force her to cooperate.

Who said anything about 100k? If your spending 100k on legal fees and asking these kind of questions on a reddit forum. Bro....

None of what you asked would even remotely relate to someone else's case in any regard. Im pretty sure your a bot.

None of this matters bro lol. Im just asking if I need help drafting the final judgment or not.

Thats what i was thinking. Theres basically just 2 conditions he rulled on. No custody, no home, no property or assets.

He lumped together her share of the cc debt, my lawyer fees and the balance on the loan for her boob job.

Well she blew through my $10k retainer in 4 weeks. I'm worried its going to cost me another 2-3k for the final judgment and possible motion to have the clerk assign the title to me. Like I said, its a very simple case. The judges ruling was: her extramarital behavior contributed to the divorce. She must pay me $14k, surrounder the car immediately and has 30 days to hand over a bill of sale and title. I can request the courts transcripts and type this up in 20 minutes.

UPDATE:: They issued a warrant for my arrest, distributing private images. I went down to the police station, was booked and immediately released, and didn't even change clothes. Blown away right now. My lawyer wants another $2k and says we should easily be able to get it dropped. The cop that booked me said he's never seen this charge in his 12 years of service.

She's already filed an ex parte and restraining order on me to get me out of the house. Both were intuitively denied, and a hearing was set. At the hearing, the judge looked the case over and said theres no abuse here, and it appears like she's trying to leverage the divorce case. He dismissed the case without hearing from either one of us. I spent $3000 on the best lawyer I could find, and she never had to say anything word.

Under no circumstances am I inviting any of her family over. She's turned them all against me, while she plays victim.

No, her ex-husbands, ex-wife. It's twisted, I know. He divorced a few months ago but they were still seeing eachother and had access to eachothers cameras. He tried playing it off, by sayings he's just helping out his ex-wife and she's just there for the kids.

I'm curious on what grounds were you awarded exclusive use of your house? We just filed for this same motion because she is refusing to sell and is dragging her feet. I've had 2 realtors come look at the house and then reach out to her to make sure she's on board with listing it. She's scared both of them away. She wants me to move out and back home, 1,500 miles away, while she moves back into our house and will eventually agree to sell it in 3-6 months. While I'm paying the mortgage and utiliti…

Is this an auto response? I never said anything about only fans being the reason for the divorce nor did I say anything about no fault vs contested. My text message defense to her sisters' false accusations does not meet the standard for "revenge porn" under any circumstance. It was not posted publicly, and it was not to for financial gain or to compel my wife to do anything against her will. Additionally, the pics and videos were posted on a public website, so there is no tenable argument whats…

From what I understand, even if it's thrown away, it's not a crime. Legally, we are still married and share eachothers possessions acuaired during the marriage.m. The law sees us as a single legal entity. A cop told me that if I took my wifes car, and she reported it as stolen, they wouldn't do anything. I bought her car during our marriage even if the title is in her name. Now, the judge presiding over our divorce case may not like it, but technically, it's not illegal.

To give a little more context. After I caught her cheating, my wife filed for ex parte relief and protection from abuse. The judge denied both, and a hearing was set. At the hearing the judge read over the notes and said nothing here constitutes abuse and it appears like she's trying to leverage the divorce case. He dismissed her complaint without a hearing and then motioned to move the divorce case into his courtroom from a different judge. I spent $2,000 on a lawyer for the hearing and she nev…

Actually, once it's posted on a public website, it's not classified as private anymore. At worst, it's copyright infringement if im using it for monetary purposes, according to OF terms of service.

UPDATE Both the ex-parte and protection from abuse were dismissed. We went to the PFA hearing and the judge looked the case over and said, "counselor nothing in her report constitutes abuse, why are we here?" Then he said it looks like this is a ploy to gain leverage in her divorce case. He dismissed the Protection From Abuse case without a hearing. Then he said I'm going to transfer your divorce case into my courtroom so I can preside over it. I don't think it could have gone better for me. Bes…

That's very helpfull thank you. She has lived with her mom/ex husband for the last 5 weeks. I caught her cheating on camera with her ex husband, that's when I filed. She doesn't have a job, hasn't worked in 10 months. I've been paying everything. I initially told her I was going to cancel her car insurance after I found out her cheating, and said her ex-husband can pay it. Then I decided to just let the policy run out and not renew it. So she had 4 more weeks notice. It ended 3 days ago, and she…

UPDATE: 2/23 I was at church this morning (the same church I've been going to for a year) and got up to go to the bathroom then I took a phone call so I was walking around in the hallway and a security guard came up to me and told me to stay against the wall. I asked him what it was about and he said it was a custody thing. I asked him if I was free to go and he said yes, so I walked out the door and went to my truck. On the way out there was 2 security guards escorting my soon to be ex-wife to …

100% this. It never falls solely on a 1 person's shoulders. Both people are to blame and need to take accountability for their actions and responses. If she can't self-reflect, You're gonna get wrecked!

UPDATE: It's 5:00pm on Friday and we don't have any knocks on the door. So I think I'm good through the weekend. I did pack the truck and took a video showing the inside of our house. My lawyer checked at 4:00pm and the TPO hasn't been reviewed by the judge yet. So he thinks I'm ok, UNLESS she filled additional criminal charges today against me. I haven't seen her in 5 days and haven't texted or talked to her in 3 days. We have the divorce complaint drawn up and they are serving her Monday at he…

Guys...They are wood nunchucks and a dagger. I'm not even sure what she meant by the dagger, but I don't have a knife. Maybe a steak knife in the kitchen or utility blades in my garage toolbox. I'm not throwing the nunchucks out.

No. She has 2 kids with her ex-husband, to whom she went back to last weekend. The same man that she claims abused her for 10 years.

She didn't abandon the house, and there's no law in Alabama that would allow me to not let her back in. She's only been at her moms for a week. She didn't commit adultery at our house, it was at her ex-husbands house. I agree with taking all my valuables and storing them some where else, thats a good idea. I already took a video of the house. I've contacted 2 realtors to list the house as well.

I understand that. I also can't afford to pay the mortgage, utilities, both car loans and everything else PLUS rent another apartment. She hasn't worked in 9 months
/r/Divorce_Men21/02/25 04:19 PM

That was the original plan. We we're discussing terms, until I said i'm not leaving for a month so she can find a job and get back on her feet, while I continue paying the mortgage and bills. I offered she pay her boob job and refinance her car. I'll take the $16K in credit card debt. We sell the house, she's the realtor and keeps all her commission. She said no, to the car loan and boob job. Then she filed the TPO to get me out of the house. Still waiting for the knock on the door.

I'll pack a bag and take a video of the house and it's condition. Good point. My lawyer said be kind to the police and respectful and just say we're going through a divorce and do whatever they ask, as far as leaving the house. But don't say anything else.

It's crazy. I don't even recognize the woman I saw in the videos at her ex-husbands house last weekend. Her speech was different, she looked hollow and brain dead. It was crazy. I have videos clearly showing them kissing on the couch before he shut the cameras off. She's also seen popping pills, vaping and drinking. Shes on probation for possession of marijuana and missed her quarterly check-in last week. My lawyer said if it's granted, a hearing will be held in 10 days.
/r/Divorce_Men21/02/25 02:45 PM

Possibly. My lawyer wants to wait it out and see if a judge even signs it and to what extend.

Absolutely. Dozens of texts. Even in our group thread with her ex-husband, she says he was her captor for 10 years and physically, mentally and sexually abused her, their entire 10 year marriage. She had 3 full blown seizures at the end which nearly killer her. The doctor told her she would eventually end up dead if she didn't leave him. So she filled for divorce.

We had our first meeting yesterday. I caught her cheating 5 days ago and she's saying its harassment because I sent her and her family the videos. All of her family is absolutely blown away that she went back to her ex-husband who she claimed was abusive for 10 years and gave her 3 seizures at the end of their marriage.

I'm in the house right now. Your kidding about the weapons, right? The kids play with them in the backyard.... The house and car are in my name and we bought them during the marriage.

There would be a hearing in 10 days, my lawyer said. There is an ex-parte request in her petition. I work remote from home. So the police could literally come here and escort me out without being able to pack my bags and computer which is my livelihood?

I moved from Montana to Alabama to be with her. I figured she doesn't have any legal reason that would warrant alimony. I just want her to refinance her car loan and surgery. She's also on probation for getting busted with weed in her car, with her kids in the back seat.

Her lawyer just called me so I'm retaining my own. She's also on probation for possession of marijuana. Here we go!

She just agreed to mediation later this week. We'll see how that goes. Its common practice to split mediation 50/50 right?

The marriage lasted 14 months to be exact. We eloped 5 weeks after our fist date. We barely know eachother, lol. You honestly think she deserves alimony?

She shares 50/50 physical custody with her ex husband. They are with us 50% of the time.

Not at all. She was let go by her employer. I never asked her to stop working. Then she realized she has it pretty good just sitting around all day on her phone so she decided to not look for work, even though I asked her to.

Its in Alabama which an equitable distribution state. The kids are in public school and ride the bus from our house. She is diagnosed ADHD but is absolutely willing and able to work. She was working part-time at a dermatology skin care place before they let her go. She also actually kept her real estate license active but she never worked on listing any houses. The last house she was an agent for was when we bought our house.
/r/Divorce_Men17/02/25 01:32 PM

Ok so everyone's is saying it's a bad idea? So what should I do? Sale the house with a different agent and ask her to split the loss?
/r/Divorce_Men07/02/25 03:10 PM

Her credit score is a dumpster fire, but her parent always help her.

I'm just brainstorming and gathering opinions before finalizing the settlement. It's a unique situation with her being a realtor. Oddly enough.... she was the realtor when divorcing her 1st husband and selling their house. Maybe I let her keep 20% of her commission as incentive to not mess it up? Is it reasonable to ask her to refinance her boob job?

Well I'm comfortable in the fact that I trust her and I know 100% she won't cheat on me. But it's also a boundaries and respect thing to. We both got ourselves into this situation with the fighting so I can't blame her for that. I'm worries because she is showing some traits of BPD and I just want to make sure I'm not loosing my mind, lol.

Yes, that's what I thought initially. She reasured me it just worked out with his schedule. He comes and visits them 2-3 times a year. I actually stayed over at her house last weekend, so it's making it even harder to comprehend. When I told her I'm having a hard time understanding her reasoning she said that she is worried about me talking to other girls all night. She is trying to turn it around on me I think.

Let me reiterate. I trust this woman. I know she won't cheat on me. I'm not completely comfortable with the situation, but she explained it like this. He needs a place to stay, he's flying in and doesn't have a vehicle and she wants him to spend as much time with the 2 girls as possible. They've been divroced for nearly 10 years and all she does is complain about how lazy he was and all the things she didn't like about him. She could have easily went back to him dozens of times before me. She is…
