Have a look into retro-active consent. I'm not going to go into detail, but my ex-wife during a joint session said that I forced myself on her. It was our first time together, in a foreign country, 17 years prior. I found that it could be considered a violation if I had waived our confidentiality. It wasn't the therapist that let me know, but my lawyer. Be very careful.

What you pay in alimony isn’t up to you. Depends on state, income at date of separation, and length of marriage. You are certainly in the long term category. Expect it to be costly. That said, I retired after my divorce. It’s been about six months and I’m struggling to fill the time. I’m sleeping too much. I’ve read / fished / hiked more than I ever have in my life. I’ll probably pick up a part time job after the holidays.

Yep, look closely at how she treats her parents. In my case it was constantly arguing with her mother, even though they were half a world away. Why argue? Accept her input, say thank you and move on with your day. What could you possibly hope to gain by arguing with someone who has near zero insight into your daily life.

Pay for the consult. The reason to pay for the consultation is to prevent your stbxw from using them as representing her. Guessing you’re in King County. I went with McKinley Irvine, but also consulted with Genesis and Weintraub. All were well qualified.

Romans 1:18 as written by the apostle Paul. Edit to add that in the book of Romans it speaks a lot of G*d’s wrath, which if being completely specific isn’t hate but anger. I’d postulate it’s close enough, but as a mortal what do I know?

YMMV, mine was a solid pit viper. She got a couple of provisions into the final agreement that is going to save me a ton of future payments. e.g. If for what ever reason I was not employed that spousal support would pause. If I was unemployed for a year spousal support would be forfeited. That and if for any reason I lost future RSU vestments I would not be responsible for the missed vestments. So as soon as the decree was finalized I resigned my position, saving me a mid-six figure payout over …

Life is not that black and white. There are too many variables in each person’s life to make overly generalized statements. That said, there are a few constants we can rely on. Best thing to come out of divorce these days is that these constants are being properly defined and correlated. What are those constants? well you should be able to infer them by reading through the posts that come up daily. In my case, I lost a well plotted trajectory for long term success, a big chunk of equity, and gai…

Can you clarify what you mean by “She wants the majority of the tax return”? Are your finances not combined? If not that’s a problem. Usually once you reach the point of starting the divorce process you follow it through. The reason for this is because you’re now adversaries. She will do as much as possible to get an outcome that favors her. If that means stalling, taking more than what’s fair (tax return money) then that is what she will do. Therapy is good, but the advice of your attorney shou…

Can confirm. Lived in Asia, learned the language and had an above average lifestyle. Mainly because of the way Americans are perceived in that country. Was there for just over 5 years when my wife wanted to do her masters degree in the states. Huge mistake. I didn’t notice at first, the shift was gradual. Eventually she was no longer the same person. Cared less and less about our household and family. Started hanging out with divorced single women. Then bam, divorce after 17 years. Should have s…

I kept her on all insurance until the final divorce decree was signed by the commissioner and logged into record. This was the advice my attorney gave me. The reasoning being I could be held liable for any accidents / issues that happen in between separation and finalizing the divorce. Not saying you would be liable, but attorney's fees to fight any issues would cost more than the insurance premium.

Right about what exactly? That your wife is having an affair? Your statement shows that your need to be right is stronger than getting the best possible outcome. There is zero tangible benefit from gathering more evidence. Okay, I’ll play along. Let’s say you uncover videos / pictures of them being intimate. You also find proof of their communications. Receipts for hotel rooms. You present this to her. What do you think her reaction is going to be? Is it going to make her more willing to come to…

Don’t bother. What purpose would it serve? To prove you’re right for ego’s sake? Drop that ego and go full terminator. You should be a machine that is focused solely on outcomes. If it doesn’t progress to the end game don’t bother. I went hunting and found more than I cared to, and it didn’t mean a thing. She still lied and only admitted to what I could prove, and with each new piece of evidence was a denial, then a lie, then a rationalization. Again don’t bother, it’s just pain shopping.

We split all liquid assets 50/50. Joint account was split and closed. She kept what was in her checking account and I kept what was in mine. When the house sold proceeds were sent to two different accounts 50/50. We didn’t have any consumer debt. She took a car and I took my truck. I took her to the license office and had the title transferred to her name. That said I continued to pay all insurance costs on advice of my attorney. Since we were still technically married I could be held liable if …

Keep everything about your daily routine the same in her eyes. Start preparing for what comes next. Speak with a few attorneys and research what to ask during an initial divorce consultation. This will help make the most efficient use of their time and your time. Once you make a choice on which attorney to use retain them and start the process of filing. Also get a recommendation from your attorney for a third party mediator. In most states they require you to at least attempt mediation. Don't c…

Spot on. 17 years for me, and would be lying if I said she doesn’t occasionally creep back into my thoughts. My first move was to block her everywhere. Helped so much. If there is custody exchange involved I’d use a custody exchange app and keep all communication confined to that.

You're pain shopping, please for your own sake, stop. Block her everywhere and focus on what you're doing. She's not your wife any more. I get it, I went through it too. Best bet is to find a local spot and plant your self. A gym, a cafe, hell even a bar ( as long as you're not drinking excessively ). I found trivia at a couple local spots. I suck, but chances are you'll find a team to pick you up, as long as you make your self available and ask to join. I've never been told no.

It was strategic. If you pay for a consult with an attorney they would not be able to take my ex as a client, as it would create a conflict of interest. First I went with the firm with the highest success rate, in both contested and non-contested divorces (McKinley Irvin). Second I consulted with Genesis, which specializes in the native language of my ex. Third was an attorney on the east side with slightly lower rates, but a high success rate. Cost roughly $1,500, but was worth it to ensure the…

If this is a facilitated mediation let your attorney know what you want and let them do the talking. If necessary request a side bar in private if things start to go side ways. If it just you, her and the mediator, get a pre-brief from your attorney and if necessary don’t hesitate to request a continuation on another day, giving you time to get your attorney’s perspective on what’s being requested. Although you should have a good idea of what’s being requested before entering into negotiations. …

Get an attorney, or at least consult with one. Your debts and assets are shared. Don’t get stuck with a bad deal because you wanted to save a few thousand dollars in attorney fees. I used Elizabeth Hoffman over at McKinley Irving as personal representation and Reed Longyear for mediation. The cool thing about Reed Longyear is that they handle all the document preparation and filings. Never saw the inside of a courtroom. You need an attorney. You never said how long you were married, how many children you have, their ages, which state your in (it matters, are you in an equitable division or community property state?). My ex-wife was making a lot of the same demands. Ultimately I hired an attorney, who recommended mediation. I paid my lawyer, and we split the cost of mediation from the equitable property. I did pay alimony (spousal support) in a lump sum, and bought her out of my retirement accounts and brokerage…

This may not apply, but worth looking into. When I was working overseas, I still had to pay income tax to the US gov on money I made outside the country. Paid taxes to the country I was in and the US. Sucked. Not sure if that applies to Canada, but you might want to check.

Age is certainly a factor. Those in their 30s will probably have lower losses and a better recovery trajectory. Usually men hit their financial stride in the late 30s / early 40s. I’m 42, so I should be back to where I was in less than 5 years.

There isn't enough information in your post to provider a proper perspective. Ages? Kids? Own a home? Substantial assets? Length of marriage? State? The advise you're likely to receive here is to continue down the divorce path, especially after infidelity.

In my state the date of separation is the date when you were permanently no longer cohabitating. If they moved back at any point, even if for a few days the clock resets. This is also something that would need to be agreed upon by both parties. I was able to negotiate a date that was a month out from my expectation. In the grand scheme of things a month isn't a big deal.

It's not a complicated equation. How much money is 50/50 of the mortgage, impact to the credit score, the likely auction value and projected out to the likely settlement date. Take which ever value is higher I agree with you on the court route. However, I'm not familiar with how UK family court operates. Personally I had a dozen spreadsheets tracking every cent related to assets and monies I paid. End result was 50% reimbursement of all expenses and 50% of the assets.
/r/Divorce_Men06/01/24 07:07 PM

Stop paying half of the mortgage, let the mortgage go into default. Eventually the lender will send it to auction and any overage on what’s owed would be payed out. Split that with the ex and move on. Otherwise he should get his solicitor to file a motion to compel with the courts. Then be prepared to wait a year or so.

There were 4 considerations when I calculated mine. What was the strike price(s) at the date of separation? What is the value of the required stocks on the date of separation? What is the vest dates on the allotments? What is the tax liability on these vested shares? I built a spread sheet to make tracking each quarterly vestment period easier. Take the total vested, divide by 50%, deduct the required taxes from the strike price on the date of vestments, determine what the delta between the DoS …

Depends on the circumstance. For my family, my parents, both of my brothers (and their wives and their children), and my uncle live in the family home. This isn't about liquidating equities to make this happen. It's more about what to do with the proceeds from the home sale. Ain't no way I'm selling equities to make that happen. The cash position is more than enough to build a mortgage free home in the sticks. I have the opportunity to have a home with near 0 cost moving forward, versus staying in a corporate environment. I don't want to sound gauche, but it offers opportunities.

Happy cake day. When it comes to what you lose it depends on how old you are. I spent the first half of my life sacrificing my time and energy to ensure I had a comfortable future. Sure it cost me a lot, but I know I'll come back from this. So will you. I saw your previous post and disagree a bit. Yeah, I wouldn't say it was easy. However, I get what you're saying, easy in the since you don't have to keep lines of communication open. That's the thing I'm already in a Pacific Northwest kick-ass city, with a kick ass career. The challenge is that my dad is asking me to come home to take over the family business, as neither of my brothers want to. Deal comes with a land deal and majority ownership of the company. Bad news is it's in the middle of nowhere. Tough call, use the capital I had to liquidate to build a house with 0 mortgage or stay in a high paying / high demand field away from family.

Funny thing is when I told her that I wasn't moving out she moved in with a friend and eventually got a cheap apartment nearby. The day she moved to her friends I found myself at u-haul buying boxes. I couldn't change the locks, but I did install security bolts like the ones on hotel doors.

Yes, and it's a good thing. If you pay for a consult it creates a conflict of interest. Which means your stbxw can't consult with them or hire them for service. One of the best pieces of advice I got was pay for a consult with the top three firms in your area. In my case I paid for a consult with a firm that specialized in my exs language. One of the bright spots was when she asked me if I had consulted with them.

Luckily, she was fine with splitting it as it was. She didn't have a choice if the filing was done in a community property state. Best case scenario is you set the date of separation and the market comes up after that. Which in this case it probably did. In my case it was a loss of 27% on her side as the strike price was set at the date of separation and the transfers were done at last week's strike price.

Ha, same thing on some of my 2021 investments. I took 90% of the cash from our joint account, not a small amount, and placed it in my personal brokerage account. I did this because my gut was telling me something was off. Turned out to be the correct move. You hear stories all the time of the cheating spouse draining all the accounts before filing. In my jurisdiction it's called a cohabitation agreement, and requires 2 attorneys, 1 for you and 1 for her. Notarized and filed with the county. A friend of mine did this after his second divorce. I believe you’re giving his ex-wife too much credit. My experience is that most wives don’t think that far ahead. An unpleasant situation presents itself and they bail because they’re not comfortable. Sucks for sure, but there is zero incentive to stay and plenty of incentives, at least in the short term, to leave. Hopefully it works out for him.

It’s all about how you structure the settlement. I personally decided to buy her out of the stock equities and retirement using proceeds from the sale of the house. No, I was in a relationship for 17 years, married 7. The divorce destroyed me, financially and emotionally. I was asked, “If you had a time machine would you undo it?” Nope, I’d do it all over again. Sure, she broke my heart in ways I never thought possible and left me a shell of who I once was, but there is a catharsis in rebuilding yourself afterwards. Fallen out of love? Sure destroy what you have because you’re not “happy”. Happiness is fleeting, search for contentment. This is one of the few instances of a man thinking the grass is greener. Good luck fella. If there are issues with your marriage work to fix them. The alternative is bleak.

I ignored those red flags and am paying a hefty price for it. If your gut is telling you something listen to it.

Talk with a few attorneys is the next step. I took three perspectives, single person attorney, medium sized firm, large firm. Each had a different perspective on how to proceed. I personally went with the large firm, as they gave the best perspective and can delegate work to paralegals for paperwork. It will cost roughly $1,500 bucks to do this but for me was worth it. Keep in mind an attorney’s job isn’t just to represent you, it’s to rack up billable hours. Do your homework, organize your fina…

It’s heartbreaking really. I think I need a break from Reddit. These trends are too common and it seems like society is collapsing. Edit: I realize that that this is a fairly dark sub, but the parable’s continue to remain the same. I’m not MGTOW or TRP but it’s easy to see how those paths are an easy way. Stay strong fellas.

This is damaging your son more than you realize. His mother is his insight into women in general. If he knows she’s drinking like this it’s going to normalize that behavior in his mind. His future insight with women will be filtered through that lens. Please seek an intervention with your wife and get her the help she needs. If she refuses start documenting her drinking, receipts, video. Then once you establish a pattern of behavior call a family law attorney and divorce her. Having that evidenc…

Dated for 2 years in her county, brought her state side, went long distance for 8 years (with weekend visits), married for 7. Separated in April, working through the divorce process. It’s expensive. Thankfully we never had kids. Worked my ass off to get us into the top 5% so the financial blow is devastating. Take all the advice here sir and listen to it.

If you plan on living with a romantic interest I highly recommend you get a cohabitation agreement. If they won’t agree then don’t move in together. It will cost a few hundred bucks but will outline the financial responsibilities of the relationship. This will save you in case your state has a common law marriage statute. Also never marry, the family law system is stacked against men. https://youtu.be/sP6oQTQVzso?t=19 Edit: check the time stamp of that video. This is not a new phenomenon.

Found your post while searching to see if it’s a worthwhile community. His videos have helped me get out of the red pill path I was headed down. He is open about his past, and has detailed his story on his YouTube channel. He was a pick up artist, but is no longer doing that afaik. His videos on divorce have been a tremendous help. And I’m considering joining that community. I wonder how your relationship is going, if you don’t mind me asking.

Get a lawyer and a CDFA to plan an exit strategy. It doesn’t have to be lightning fast, but cold and calculated. You’re already educated enough to know the 10 year mark is the permanent line in California. Keep reading this sub and you’ll know what you need to do. You’re about to get an education you never wanted, but then again none of us here wanted that education. Get into therapy, chances are your company health plan will pay 100% of that.

We’re going to attempt an uncontested divorce. Since who the hell wants to give 40k+ to lawyers. But already have my finger on the button.

Sorry for the late reply. She was so deep in the fog what was happening didn’t hit her until everything was split, separated and she was in a new apartment with all our belongings split. Two weeks later her AP split. She came back with the “let’s work it out” line only after she buried herself. Only thing left to argue about now is alimony. Which should be easy enough to squash. Fellas if she is in the fog act quick.

Wonder who you actually went with, a bit late to the thread. Care to share what went down? As for scorched earth I hear McKinley is the firm. But man are they pricey. I don’t have them on retainer yet, but do have them locked out.

You’re asking a divorce sub when / if you should get married. Okay. IMO If you’re speaking English never marry. The Western world divorce machine will chew you up and spit you out.

One of the more satisfying conversations in the last few months is my stbxw telling me that x wouldn’t be able to advise her. Petty sure, but satisfying YES. Also if I didn’t mention it stay in your home. Give / pay for another place for her to live. Never leave your home.

I’m in Washington, the first thing to know is that if you have a PAID consult with a firm they cannot and will not take a consultation with your spouse. Use this to your advantage. Weintraub, Genesis, and McKinley, book a paid consult with these firms. It will cost you roughly 1.5k but is worth it to lock them out. Best bet, if you can do it, is meditation. Which means you agree on everything before you even set the appointment. Otherwise expect a long and expensive road ahead. If I was going th…

This is correct. By the time she says “I love you, but I’m not in love with you.” she disconnected at least a year ago. Don’t be surprised if she attempted to monkey branch. I know my stbxw did. Get ready to pay, financially and emotionally. Turn inwards and focus on what being single looks like in later life. Don’t move out of your home and if possible get her a new place and set a date of separation.
