Don't. The probabilities are worse than winning in a casino. Money can always be made but when children get involved, it becomes even worse.

We haven't even been to court yet for divorce. I have a criminal case on this whole thing going on at the same time.

I never hit women. She does what we call, reaction abuse. But like is the goal to take the kids completely away from me? I mean for financials, shits going to get split either way.

Toddlers, under 4. I don't plan to go this route at all but I just want to be prepared to have an offense ready if there's a custody battle. Id like to move on and focus on my kids.

Oh I don't want full. I believe the kids also deserve equal time with their mother as much as I dislike her.

I plan to. I don't care about paying child support. She doesn't work. She refuses to work. I'm just saying I know her attorney is going to drag in the criminal case to prevent me from getting 50/50.

A pending falsified DV criminal charge against me. I have no history of violence.

Thank you for this. This actually sounds like a very good idea to flush all that bs out of the mind.

How were you able to manage to get that dropped? The wife didn't want to press charges?

Recent events occured with other family members has put me in the direction of getting a lawyer. I have concerns for my children now.

Sorry I had to keep details ommited for privacy. They were definitely 100% false and the affidavit doesn't describe what she's telling people. I wish I could share more. She has alcohol and substance abuse issues. It's been witnessed by family members especially when she's been in incidents with our son. It's a big mess. There's many details I wish I could share but her lawyer is a snake so I can't chance it.

I don't know. My father had to fight. But knowing who my mother is today I wouldn't blame him if he didn't want to fight. Because ultimately I ended up living with him anyways the rest of my teenage years and beyond. And they were never married.

That's why the one I consulted with told me my lawyer has to get me a GAL if I want 50%.

This is Indiana parenting guidelines as minimum to follow. I don't think it discusses laws on 50/50 custody. I know many people who do have 50/50. So it's not impossible. I work 100% remote, for years. So there's no reason why I wouldn't be able to get 50%. Thanks for looking though. I love the support of this board.

Good point. And no she won't get the house because she can't afford it and it's in my name. I was ordered by the judge because her lawyer said we could not co-habitate. That was the only option otherwise she had no where to go that wouldn't take the kids 3 hours away. We still could have co-habitated. Now since I've left, she's had family stay more then 50% of the time since the day I left. It's so fucked up. I don't know how she is allowed to do all this. My lawyer I think is planning to go for…

What sucks is I'm paying her support on top of paying a very expensive mortgage and all of our bills while she lives there and I have to take up a room with family. I couldn't even afford to get my own place if I wanted to. The house is in my name too. It's complete bs.

Jesus. That's terrible. Doesn't the GAL have to provide justification for her decision to the judge other then "the mother is better"?

I'm looking. Specifically for a female lawyer. Mine is barely fighting and extremely slow at responding.

My lawyer is slow in responding. I'm sorry cannot I not ask freely here from the experienced men who've been divorced?

Yes unfortunately because she made the case we can't live with each other amicably, the judge ordered me to move out. My attorney fought and put a timeline on this to get to settlement within 90 days.

He said I would have to go to court on it and they would fight it and it would delay this 90 day timeline on it. So I emailed this morning to get more clarity but it is bullshit. She ripped a camera and high voltage is exposed outside.

I was court ordered. She has no job and no other place to go. She also got temp custody because of it.

I have to move out this Sunday and the lawyers I have are barely moving the needle. They care more about the financials. While I will likely get joint custody after the settlement, 3 months with very little time with a 9-month-old and a 2-year-old is completely unreasonable. I told my attorneys time with my kids is very critical for them. I don't know what other legal options I have here.

We don't have a separation agreement. It was just temp custody and me to move out this Sunday. All happened last Thursday at our first hearing. We have 90 days to get things assessed and mediated and we meet again.

That's some bs. Well the judge told her, flat out, I'm the first she calls, no one else. I have told her we can co habitate together as we have a big house. No need to put someone out on the street. But you know how this goes. Even though working two remote jobs and being a hands-on stay at home dad, I still got kicked to the curb. She was refusing to find a job. She is very lazy. I feel she's going to park in the home for a while because of her laziness. So judge ordered her temporary custody, …

Well there is from a judge using Indiana parenting guidelines. I don't get overnights however my attorney informed me that if she gives me more then what the judge orders and Indiana guidelines and I have it in the written parenting plan, it's fine. The judge looked her dead in the eye and said when the kids need to be watched, I have to be the first one called. Her mom however is under the impression that she can come and take my place to help out. I DONT want that to happen because this is wha…
