Here is the deal. 99 out of 100 GAL’s out there are going to take your money and say “best interests of the child are to be with mother, and father should get visitation.”

Secondly, don’t fall for the whole “oh, just me full custody now and in time we can re-evaluate.” Once courts make a decision on custody and parenting time? It will stick forever.

I had a very well respected GAL. I wanted greater than 50/50 bc my ew was telling my kids and others that I had abused her sexually. (I did not). I thought her psychological state was harmful to the kids.

The GAL gave a recommendation that mom be primary parent. She said that if mom and I could agree to different terms from the specific recommendations she would sign off—except for 50/50. She (GAL) said she would not agree to 50/50.

The “investigation” the GAL did for my case was to have a 1 hr meeting with mom; 1 hr meeting with dad; some bs email exchanges that are he said/she said; 1 hr visit with kids while with mom; 1 hr visit with kids while with dad. I had affidavits from friends and her family stating I was a better parent. I had video evidence of her telling my kids that I had sexually abused her, etc. None of it mattered. And I had a “good” GAL.

So…I paid the retainer for the GAL. It delayed the case for at least 6 months. And i believe I got less than I would have gotten without the GAL.

In hindsight, I wouldn’t recommend a GAL unless there was direct evidence of physical or drug abuse. And that evidence would have to be beyond a shadow of a doubt. Even then, there would probably remain a stain on your character for not having prevented it in the first place.

Your lawyer is correct that the GAL will delay the case. You will also be paying an additional retainer.

If you don’t get 50/50 now it’s going to be very difficult to get it changed later. You can spend the money and time now or spend it later fighting an uphill battle.

You need to stick to 50/50 and die on that hill.

What state are you in? Have you looked up your state law yourself to see what it says?
