I will happily do more research, since I'm not sure the legal details, but the right to adopt away without consent from the man exists only if the man has not filed for or claimed paternity. It is not surprising that a man has no rights over a child that is not legally his. It should also be noted the men in these situations have no legal responsibilities either. You can claim paternity after the birth for some period as well, though it is fairly short (a week?). If I am right this makes this story slightly suspect given that the man could have claimed and tested for paternity and asserted his rights. It also makes the title of the piece wrong- the children aren't legally these men's children. If he man in the article isn't the biological father and not married to the mother then he is SOL without the mother granting paternity.

The laws in Utah are very adoption friendly and things can move quickly. LDS family services and other things mean that a person that wants to adopt out often has much more access to information and legal counsel than does a biological parent that wants to keep the child. If the father doesn't know about the birth and hasn't claimed paternity, there is no legal need to inform him and I know guys whose clocks expired before they even knew about the birth- the judge later grilled the guys on why they had not filed in the many months of the pregnancy. It is completely possible and legal that an unwed father assumes the mother wants to keep the child, takes no action and gets hijacked by an adoption later. I am personally connected to situations in which both of the above have happened, AMA if you want. There is definitely a lack of father's rights, but perhaps not to the degree this article claims.

I am personally connected with several people on both sides of adoptions at/near birth in Utah and am happy to get details if wanted.

I'm confused. How does LDS get more Mormons out of this?
