I'm not really seeing anything that says he had any grounds to take her out of the country in the first place. usually it doesn't matter who takes the kid out of country, as long as they are the custodial parent, unless otherwise indicated (it is possible to have custody and be ordered not to move out of state/country).

actually i know of at least one case in which genders were reversed; separated parents, children under fathers custody, mother takes children abroad, police get children back mother goes to jail.

Since its not my own story i'm not going to put any greater detail into it out of respect for the people involved, but from my personal experience it works both ways.

Also you're definition of 'perfectly legal' and mine vary slightly:

"Her father Razwan Ali Anjum is serving a prison sentence for refusing to reveal his daughter's whereabouts despite a court order."

"Courts have been told Anjum said he was taking Atiya to Southport, but instead took her to Lahore, Pakistan, and told Ms Wilkinson that she would never see her again."

The child was kidnapped; and then the father lied about knowing her whereabouts. Thats illegal and deserves to be punished. no two ways about it.
